வெளி ஜாதியில் கல்யாணம் செய்தால் விவாகரத்து!

இதுதான் இஸ்லாமிய ஷாரியாவா? என்று தலைப்பிட்ட பதிவில் அனானி அன்பர் ஒருவர்
பின்னூட்டமாக இட்டதை இங்கே பதிக்கிறேன்.

Tribe forces couple to divorce

JEDDAH, 3 March 2007 — Another case of tribal incompatibility as a basis for intervening in a marriage and forcing the couple to divorce against their will has come to light.

This time, an Eastern Province couple, who go by the initials H.M. and A.O. to protect their identities, have been receiving harassing phone calls and threats from the family of A.O., led by an elder who firmly believes marriages must remain within the tribe.

“It was a daily nightmare,” said A.O., the wife who works as a public health specialist for a leading company. “No one stood by us.”

The couple have complained to police about intimidation, harassment and outright death threats by tribal members in Al-Hassa, led by a tribal elder.

The case is complicated by the fact that H.M. followed standard cultural procedures that included obtaining permission from A.O.’s legal guardian — her brother — and the wife’s mother (her father has passed away). Women of any age in Saudi Arabia require a legal male guardian who must be a family member.

Shortly after their marriage in December, the tribal elder in Al-Hassa appeared and objected to the marriage, claiming that all members of the tribe must marry inside the tribe. A.O. says she and her branch of the tribe had not heard from this man in years.

Still, this elder took action, filing an objection to the marriage at the Eastern Province municipality. Alkhobar authorities tried to resolve the conflict amicably, but the elder was insistent on the annulment of the marriage, which H.M. refused.

Then the threats began. Members of the tribe living in distant parts of the country began phoning threats. It appeared to be some kind of campaign organized by the tribal elder to threaten, harass and intimidate the couple. H.M., who works as the general manager of a large company in Alkhobar, said tribe members visited him at his workplace to make threats. Other members of A.O.’s family were also targeted with threats.

“These people had every intention of harming my wife and her brother and they made that very clear,” said H.M., who pointed out that some of the people making the threats and vulgar, highly offensive comments to A.O.’s mother are prominent government workers and college professors.

The couple have filed complaints regarding these harassments with police in Al-Hassa, but little has been done.

“We want to know who have been calling and sending those text messages because this is chaos and complete disrespect of the law,” said A.O.

They saved all the phone numbers and text messages, most of which were made through calling cards. But some were also made from home phones or mobiles. They submitted a list of suspected names behind these threats.

Meanwhile, A.O.’s mother’s health has been deteriorating and the couple decided the only way to stop the harassment of the mother was to file for divorce. H.M. signed the divorce papers in January.

“The main reason I decided to divorce is for the sake of my wife’s mother,” said H.M. to Arab News. “They were under so much pressure and it was taking a toll on her health and I was really starting to get concerned about them and if something happened to any of them I would never be able to forgive myself.”

The couple are now examining their options for seeking justice through the courts. However, recent reports of other high profile forced-divorce cases have given the couple little hope.

“I feared that the chances of winning a case are slim given that in similar cases the outcome was unfavorable. There is no clear and consistent ruling in these cases,” H.M. said.

H.M. was referring to the controversial Jan. 21 Court of Cassation (appeals court) ruling that upheld the decision of a lower court that forcibly divorced Fatima and Mansour Al-Timani at the request of Fatima’s half brothers. In that case, the divorce was sought based on tribal incompatibility.

Fatima’s family claims Al-Timani deceived them on his tribal background. They were divorced in absentia last year then later arrested for co-habiting outside of marriage.

Fatima languishes in an Eastern Province prison, unwilling to return to the custody of the family members who forced the divorce.

The couple have two children — one in prison with the mother and the other in custody with the father.

தான் பிறந்த குரேஷி குலத்திலிருந்து 12 காலிபாக்கள் வந்த பின்னால் உலகம் அழியும் என்று சொன்னால், அதுவரை குரேஷி என்று குலம் இருக்கும் என்றுதானே பொருள்? குரேஷி, அன்சாரி, சையது, அஜ்லப், அஷ்ரப் ஆகிய ஜாதிகள் எல்லாம் உலகெங்கும் உள்ள இஸ்லாமிய சமூகங்களில் இருக்கின்றன.

"6:165 அவன் தான் உங்களைப் பூமியில் பின்தோன்றல்களாக ஆக்கினான் அவன் உங்களுக்குக் கொடுத்துள்ளவற்றில் உங்களில் சிலரைச் சிலரைவிட உயர்த்தினான்"

என்று சொல்லி, குரேஷிகளே மற்ற ஜாதியினரை விட உயர்ந்தவர்கள் என்று சொல்லிக்கொள்கிறார்கள்.

அவரது ஜாதியான பானுஹாஷிம் தான் உயர்ந்த ஜாதி என்று அவர்களே மன்னர்களாக ஜோர்டான் போன்ற நாடுகளில் ஆட்சி செய்கிறார்கள்.

It is myth that is produced by indian media, that none convert to hinduism. i want to clearly say that hinduism is the fastest growing religion in the world. there are 22,000,000 neo-hindu converts from islam and christianity. in india, now christians and muslims are converting in huge masses to hinduism, and not the viseversa, and this should be, as there is no morality to become a christian or muslim. i am a lady from Aligarh , and i was gangraped by rowdy muslim guys. i had gone to maulana , but he proved himself as bustard. he adviced me to marry that rapist , according to sharia rules. Then i decided to leave islam. i thought to be christian at that moment, but i foung the mother teresa missionaries, convert only due to superficial conversions, so i left that option

At last i contacted Bajrang Dal group, to get justice, they looked me as sister, and they gave me shelter and protection. Even they never said to become hindu for that price. Later , when i understood that VHP and Bajrang Dal had respect for other religion, but they opposed that there people not to be converted only because of money, so i found that hinduism is so broad minded and they only respect females. i found they worship lady as mother shakti, so i decided to convert to hinduism . I now daily chant gayatri mantra 3 times a day. Thanks to VHP and Bajrang Dal.

WASHINGTON, DC (PRWEB) March 19, 2007 -- On the heels of this past week's celebration of the 1,000th signature on the Muslimah Writers Alliance (MWA) Say 'No' to Forced Divorce - 'Yes' to Reforms petition, the Saudi Gazette affirmed a report that the Ministry of Justice in Riyadh, Saudi Arabia, has organized a new committee to investigate the trend of forced divorces based on unequal tribal background.

"This is great news, not only for the couples who were forcibly divorced, but for all Saudi women," said Foziyah Al-Ouni, a Saudi woman who has been an active supporter of those enduring the hardships associated with cases of forced divorce.

"While I agree 100% that this news rekindles hope within the hearts of women of Saudi Arabia, let us be reminded that this announcement, and the anticipated corrective actions that could potentially be derived from the formation of the investigative committee, are a cause for celebration by Muslim women world-wide," stated MWA Director, Aishah Schwartz.

The petition's signatures represent unified Muslim voices from more than 40 different countries.

"Let the chorus ring loud and clear, when given a platform, the universal Muslim community will stand united in calling out that which is inherently wrong - to stand up for that which is right," Schwartz added.

Commenting on the case, Nimah Nawwab Saudi poet, activist and Young Global Leader stated, "The Al-Timani case brings to the forefront the problem of the evolving abuse of guardianship (wali al-amr); an abuse affecting the rights of women throughout the Kingdom in marriage, travel, education and work."

"Guardianship has been reduced to nothing more than a means of control, whereby even distant male relatives are unwittingly given authority to decide the fates of female family members with little or no regard at all for their best interests," Nawwab concluded.

Long after the case of Fatima and Mansour Al-Timani is settled, the online petition drive will continue to accrue signatures until the requested reforms pertaining to guardianship over women are addressed.

"The whole world is looking for humaneness. Anybody who works for faith, nation and moral values will never be a loser," stated the Custodian of the Two Holy Mosques, King Abdullah bin Abdul Aziz at this year's National Festival for Heritage and Culture at Janadriya in Riyadh.

The couple's attorney, Abdul-Rahman Al-Lahem, was recently nominated by the UK's Index on Censorship Freedom of Expression Awards committee for the 2007 Bindman's Law and Campaigns Award.

It is high time we start the Hindu channel to explain Hinduism to Arabs and bring them to the anbu vazhi!
