இஸ்லாமிய ஷாரியா: எகிப்தில் ஆறு நிமிடத்துக்கு ஒரு விவாகரத்து

சீரழியும் சமூக உறவுகள், குடும்ப உறவுகள் காரணமாக எகிப்தில் ஆறு நிமிடத்துக்கு ஒரு விவாகரத்து கேஸ் கோர்ட்டுக்கு வருகிறது என்று எகிப்து தெரிவிக்கிறது.

பெரும்பாலான கேஸ்கள் ஆண்களாலேயே வருகின்றன. ஆண்கள் எந்த விளக்கமும் கொடுக்க தேவையின்றி எந்த பெண்ணையும் விவாகரத்து செய்யலாம் என்று எகிப்தின் இஸ்லாமிய ஷாரியா தெரிவிக்கிறது.

ஆகவே, ஆண்கள் நான்கு பெண்களை திருமணம் செய்துகொள்ளலாம் என்பதால் பலர் நாலாவது பெண்ணை தலாக் செய்துவிட்டு மற்றொரு பெண்ணை திருமணம் செய்துகொள்கிறார்கள்.

மேலும் ஆண்கள் விவாகரத்து செய்ய கோர்ட்டுக்கு போகவேண்டிய தேவையும் இல்லை.

இதனால், 76 மில்லியன் மக்கள் உள்ள எகிப்தில் 2.5 மில்லியன் விவாகரத்தான பெண்கள் இருப்பதாக அரபு நியூஸ் தெரிவிக்கிறது.

Divorce in Egypt every six minutes

CAIRO, Nov 20, 2007 (AFP) - A couple files for divorce every six minutes in Egypt, with a third of marriages breaking up in the first year, the press reported on Tuesday quoting the state-run statistics bureau.

Courts across Egypt rule on 240 divorces each day, according to the Central Agency for Public Mobilisation and Statistics (CAPMAS)

In most cases men take the initiative to file for divorce since under Muslim sharia law they are allowed to seek unrestricted legal separation from their spouses while women must face long court procedures.

In line with sharia, men do not need to go to court to file for divorce and can take up to four wives.

Egypt, home to 76 million people, now has 2.5 million divorced women.

இக்பால் பானோ தீர்ப்பு: முஸ்லீம்களில் விவாகரத்துக்கு பிறகும் மனைவிக்கு ஜீவனாம்சம் தரவேண்டும். - சட்ட அமைச்சர் விளக்கம்

இக்பால் பானோ vs உத்தரபிரதேசம் வழக்கில் மே 2007இல் வந்த தீர்ப்பை சட்ட அமைச்சர் பாராளுமன்றத்தில் தெரிவித்துள்ளார்.

இத்தத் காலம் தாண்டியும் விவாகரத்து செய்யப்பட்ட மனைவிக்கு ஜீவனாம்சம் தரவேண்டும் என்று சுப்ரீம் கோர்ட் உத்தரவளித்துள்ளது.

Maintenance allowance to Muslim women

New Delhi, The Supreme Court of India has passed an order to provide maintenance allowance to Muslim women from their husbands under Section 125. The Apex Court in its judgement dated05.06.2007 in Iqbal Bano Vs. State of UP & anrs. has held as follows:

1. A Muslim husband is liable to make reasonable and fair provision for the future of the divorced wife which obviously includes her maintenance as well. Such a reasonable and fair provision extending beyond the iddat period must be made by the husband within the iddat period in terms of Section 3(i) of Muslim Woman (Protection of Rights on Divorce) Act, 1986.

2. Liability of the Muslim husband to his divorced wife arising under Section 3(i)(a) of the Act to pay maintenance is not confined to the iddat period.

3. A divorced Muslim woman who is not remarried and who is not able to maintain herself after the iddat period can proceed as provided under Section 4 of the Act against her relative who are liable to maintain her in proportion to the properties which they inherit on her death according to Muslim law for such divorced woman including her children and parents. If any of her relative being unable to pay maintenance, the Magistrate may direct the State Waqf Board established under the Act to pay maintenance.

4. The provisions of the Act do not offend Article 14,15 and 21 of the Indian constitution. Government does not propose to take any steps in this regard since the Supreme Court has not given any directions to the Central Government in the matter.

This was stated by the Minister of State of Law and Justice, Shri K. Venkatapathy in a written reply in Lok Sabha today.
