இஸ்லாமிய பெண்கள் இணைந்து ஒரு நல்ல திருமண சட்டங்களை இயற்றியுள்ளார்கள்.
ஆனால், அதனை ஆண் மௌலானாக்கள் ஒப்புக்கொள்ள மறுக்கின்றனர்.

இது இஸ்லாமை கேலிக்கூத்தாக ஆக்குகிறது என்று கூறுகிறார்கள்.

Muslim women’s board says it upholds the rights of the fair sex, AIMPLB, clerics slam it

LUCKNOW: Sabeena Khanam of Shafipur in Unnao district near Lucknow is distraught. Six months ago, her husband pronounced talaq thrice and threw her out of his house with their two tiny daughters. Sabeena is forced to live with her parents and do menial jobs.

But other Muslim women may not face the same fate in future if a new nikahnama (marital agreement) released by the All-India Muslim Women’s Personal Law Board (AIMWPLB) here on Sunday is implemented.

However, instead of settling matters, the new marital agreement promises to generate more confusion and controversy. Already, some clerics have rubbished it as “redundant”.

Besides, this is the third nikahnama that promises to uphold the marital rights of the Muslim woman. The All-India Muslim Personal Law Board (AIMPLB) and the All-India Shia Muslim Personal Law Board have already released “model nikahnamas”.

“It is the Muslim woman who is wronged in the name of Islam. Our effort is to protect her rights,” AIMWPLB president Shaista Amber said after releasing the nikahnama. She claimed the earlier nikahnamas were an “eyewash” as regards woman’s rights.

The nikahnama was presented to five young girls by five women suffering due to alleged illegal and anti-Islamic talaqs. “This nikahnama is in conformation with the Holy Quran, the shariat (Islamic law) and the Hadees Sharif,” Amber said.
It is unique as it makes registration of the nikah in a marriage bureau mandatory. Besides, it makes the process of talaq difficult and extended “to provide the couple maximum time and opportunity for a compromise”.

The document carries extensive quotes of ayats (verses) from the Quran. “This was necessary to ensure unscrupulous maulvis do not oppose it in the name of Islam,” Amber said.

The nikahnama is also in synch with the times. It clearly lays down that talaq pronounced through internet, e-mail, SMS or phone would be invalid. It also says a woman would be entitled to seek khula (legal separation) if the husband suppresses information about having Aids at the time of marriage or contracts Aids any time after it.

AIMPLB member and renowned Sunni cleric Maulana Khalid Rasheed Firangi Mahali described the nikahnama as “redundant”. He told DNA: “We have also drafted a model nikahnama. This new one would only confuse people.”

Renowned Shia Maulana Kalbe Jawwad questioned the validity of the new nikahnama, saying: “What is the legal sanctity of this document drafted by the AIMWPLB.”

Another Maulana said,“ They (AIMWPLB) are making a mockery of Islam.”
