ஜேம்ஸ் டால்டன் என்ற பைத்தியக்காரர் தானே இயேசுவின் இரண்டாம் வருகை என்று அறிவித்து தன் சகோதரனை இயேசுவின் அறிவுரைப்படி வெறுத்ததில் கொலை செய்யும் அளவுக்கு போய்விட்டார். தன் சகோதரனை டெவில் என்று கருதி கொலையும் செய்துவிட்டார்.

அவர் லூசு என்று முடிவு செய்த கோர்ட், அவரை விசாரணை செய்வதில் என்ன பிரயோசனமும் இல்லை என்று முடிவு செய்துவிட்டது.

Judge rules Dalton not competent; Palo Alto man may go to mental health facility

A 53-year-old Palo Alto man won't stand trial for allegedly murdering his brother, a Santa Clara County Superior Court judge decided Monday.

Judge Thang Nguyen Barrett ruled in a brief hearing that James Dalton's attorneys have met the burden of proof to declare him mentally incompetent to face a jury trial.

A diagnosed paranoid schizophrenic, Dalton was arrested in July 2007 on suspicion of fatally stabbing his brother John Dalton, then 53, at the family's home at 325 Victoria Place.

Dalton will now undergo another evaluation by doctors - he has already been analyzed by two psychiatrists and a psychologist - who will recommend a new course such as outpatient care or a term at a state-run mental health facility.

Clad in a brown shirt and orange pants, Dalton sat quietly through the hearing. Barrett is scheduled to hear the results of Dalton's final evaluation at 1:30 p.m. on Aug. 22.

One of Dalton's attorneys, Ken Nordin, said after Monday's ruling that he expects Dalton will be sent to a mental health facility.

Nordin said the upcoming evaluation will likely be less in-depth than the previous ones and will likely reach similar conclusions about Dalton's mental state.

Deputy District Attorney James Gibbons-Shapiro said he respects the judge's decision, even though he disagrees with it.

At a June hearing, Gibbons-Shapiro did not dispute that Dalton is mentally ill, but argued that he is capable of providing assistance for his legal defense, one of the standards by which competency to stand trial is judged.

He suggested Dalton may have antisocial personality disorder, and cited a medical manual that says patients may be prone to fabricating or exaggerating medical symptoms.

But another one of Dalton's attorneys, Andrea Ambrosio, said the evidence showed he is prone to irrational thinking and emotional instability.

A psychiatrist testified that Dalton believed his brother was a devil or devil-like creature and depicted himself as the second coming of Jesus Christ, and said he does not believe Dalton was malingering.

Dalton waived his right to a jury trial to determine competency, leaving the decision with the judge.

Barrett also issued a 10-page written ruling on Dalton's competency but it wasn't immediately available Monday.

According to court records, Dalton's criminal history spans more than 30 years and includes several instances of sexual battery against elderly women.

In 1997, a probation officer expressed concern about Dalton returning home after he was treated at Kaiser Hospital's substance abuse program, saying his mother "is unable to provide adequate control or supervision."
