A BAHRAINI accused of murdering a housemaid could have accidently killed her while disposing her body, thinking she was already dead, according to his lawyer.

The High Criminal Court was yesterday requested by defence lawyer Fatima Al Hawaj to summon a medical examiner to find the real reason behind her death.

She said it was still not clear how the Indonesian housemaid died after the 38-year-old threw a screwdriver at her which hit her head.
"It is a possibility that when she received the blow, she passed out and when he checked for a pulse he thought she was dead and decided to dump her body," said Ms Al Hawaj.

"We need a senior medical examiner to be consulted in this case to understand the exact reason behind her death."

According to defence pleadings submitted by Ms Al Hawaj to the court yesterday, the defendant was trying to fix the house's garage when the maid irritated him when she started insulting him.

He threw a screwdriver at her that hit her head and she fell to the floor, it was claimed.

When the defendant checked for a pulse and couldn't find any, he thought she was dead and tried to dump her body, according to the pleadings.

It argued that the victim could have died due to being kept in the car for some time before being dumped or due to the defendant dumping her body, but not from strangling her.

Judges adjourned the case to October 26 and agreed to study her request.

The GDN reported in June that Ms Al Hawaj had requested a second medical examiner to review a disputed autopsy report on the housemaid.

Prosecutors claimed he initially tried to strangle Ami Tursiya Takiyat, 29, but cut her throat when he couldn't kill her with his bare hands, then dumped her body on wasteland.

The defendant, a government health service nurse, allegedly attacked her at the family home in Sitra, last September, but denies premeditated murder.

Ms Al Hawaj earlier challenged evidence given by Interior Ministry medical examiner Dr Yasser De'abes, who said animals had eaten part of the body and the only evidence he could find was of a blow to the head.

Dr De'abes had denied seeing any signs of strangulation and asphyxiation as they were not visible on the exterior, according to Ms Al Hawaj.

However, there would be other signs inside the body and Ms Al Hawaj said the medical examiner did not mention them in the report.

She also argued at an earlier hearing that the defendant suffered from a mental illness as he jumped into the sea twice after the incident and should be examined by a psychiatrist.

The defendant was arrested after allegedly being spotted trying to dump the body on a wasteland in Sitra.

It is believed Ms Takiyat was still alive, but bleeding from a slit throat as her attacker dragged her from the family home near the Toyota showroom in Sitra.

Her sponsor was sprayed with blood as he tried to intervene in the attack, but was reportedly restrained by family members.
