A lawyer has filed a complaint with the Supreme Board of Judges and Prosecutors (HSYK) against a judge who ruled to release two suspects arrested on suspicion of raping a 15-year-old girl and allegedly scolded the girl's mother for not watching her closely enough.
The Sabah daily reported on Thursday that the İzmir 2nd High Criminal Court last week ruled for the release of two suspects who were arrested two years ago on charges of raping H.S., who was 15 at the time. Prosecutors had demanded 18 years in prison for the two suspects.
H.S.'s mother raised an objection to the ruling. The presiding judge allegedly said to the mother in return, “You should have watched your daughter more closely.”
H.S.'s lawyer, Mehmet Şeher Özterzi, subsequently filed a petition with the HSYK demanding that the judge recuse himself on the grounds that he had lost his impartiality. The statements of the judge were not recorded in trial transcripts, but there is testimony from other lawyers who were present when the judge made the alleged statement.
The victim maintains that she was first drugged and then raped by two men named F.Ç. and U.Ç. during what she thought was going to be a friendly encounter, as she was friends with U.Ç. A third suspect, A.K., recorded the rape. U.Ç., who was a minor at the time, is currently being tried in a juvenile court. The other two were under arrest until the İzmir 2nd High Criminal Court ruled for their release last week.
A.K. is also facing charges of blackmail, as he threatened H.S. with posting the rape video online unless she had sex with him.
Shortly after the incident, H.S. suffered from depression and told her parents what she had experienced. The family immediately filed a criminal complaint against the three young men.
