A Shia Muslim was convicted of child cruelty yesterday after he forced two boys to flog themselves during a religious ritual.

Syed Mustafa Zaidi, a warehouse supervisor, told the boys, aged 13 and 15, to beat themselves with a zanjeer zani, a wooden-handled implement containing five curved blades used when commemorating the death of Hussain, grandson of Muhammad and one of the most important figures in Shia Islam. Zaidi is due to be sentenced on September 24.

Manchester crown court heard how Zaidi, 44, flagellated himself at an event held in January in Manchester until his back was bloody and cut. Others at the event also flogged themselves. Some of those present, fearing Zaidi would seriously harm himself, asked him to calm down. Zaidi agreed, only to turn his attention to the two boys.

The 14-year-old, who was 13 at the time, told the jury that neither he nor the other boy wanted to injure themselves. He said Zaidi was insistent with the older boy, "pulling him and pushing him, 'keep doing it', telling people 'this is a sad moment and look, he's not doing it'.

"He goes, 'I don't want to do it, I don't want to do it'. He kept pressuring him, make him do the knife thing, pulling him, trying to get his T-shirt off, pulling and pushing him. He was saying, 'just do it, just do it'." He said the 15-year-old "swung it once or twice and said 'I don't want to do it any more'." The older boy was then pulled away by another man.

After the ceremony, the boys went home to their mother, who noticed several deep wounds on their backs and multiple slash wounds. She took them to Manchester Royal infirmary and the matter was reported to the police.

The boys, who cannot be named for legal reasons, admitted they wanted to beat themselves, but not under duress and not using Zaidi's zanjeer zani. They also said they had flogged themselves with a smaller zanjeer zani from the age of six in Pakistan.

Carol Jackson, for the Crown Prosecution Service, said the prosecution was not an attack upon the practices or ceremonies of Shia Muslims, adding that the prosecution relied partly on evidence given by the president of the local Shia community centre. It was the first case of its kind to be prosecuted by the CPS.

For Shia Muslims the death of Hussain is a period of intense mourning, leading some to beat and whip themselves. The practice is not compulsory and some Shia authorities prohibit it, while others say it should be done only if certain conditions are met.

Safdar Zia, general secretary of the Jaffria Islamic Centre, said Shia Muslims in Manchester would now try to work with the police and the CPS towards a code of practice: "We are not above the law."

In the glare of camera lights, nine-year-old Sheetal - the oldest of the four children who were among the seven hostages rescued after a gun battle on the outskirts of this winter capital of Jammu and Kashmir - Thursday described the terror of being held captive by militants in her own house.

'It was scary. We were locked inside a room and the men said they will kill us,' Sheetal said into the microphones that were thrust towards her. 'I don't want to remember anything, but it was so scary I don't think it will go from my mind.'

Her two-year-old brother Vipin's fear-filled eyes darted around in search of his mother. But Sarita was nowhere in sight since she had suffered bullet injuries and had been taken to the military hospital for treatment.

Sarita's husband Billu Ram, who had been taken to hospital Monday to be treated for a snake bite, had returned Wednesday morning to find that terrorists were holding his family hostage in their house in Chinore, about 20 km from the centre of Jammu.

He had waited anxiously outside the building as his family members were rescued following the gun battle that went on from early Wednesday morning till late in the night. However, a neighbour, his son, and a teacher present in the building were killed by the three terrorists.

Grenade explosions and gun shots were heard in the area as the single-storey building was perforated with bullet marks. By late Wednesday, the army personnel managed to kill all three militants.

'We are happy that we could save some of the hostages but also unhappy that three of them were killed,' Brig V.P. Singh, who led the operation against the terrorists, told reporters.

'The first to be brought out was Sarita, the wife of Billu Ram. She was injured. After that, his four children were rescued,' a police officer told IANS.

The youngest of the children was Vipin Kumar, while the other three were Kajal, 4, Ishant, 6 and Sheetal.

'Later, Billu Ram's brother Tarsem and his wife Ritu were rescued. Some of the hostages are still in shock,' the officer added.

The police said three terrorists had crossed into Jammu and Kashmir from the Kanachak sector of the border with Pakistan Tuesday morning. They were intercepted at the police check post of Chinore, about 20 km north from the centre of Jammu, Wednesday morning.

The three militants, dressed in police uniforms and carrying AK-47 assault rifles, shot dead a junior commissioned officer (JCO) and then hijacked a three-wheeler. They then fired indiscriminately, killing Shabeet Hussain, a milkman, and motorcyclist Naseeb Singh before killing the three-wheeler driver, Vijay Kumar, police said.

After that, they barged into Billu Ram's house.

Fighting erupted after about 70 government vehicles surrounded Kalma camp early in the morning.

Sudanese armed forces have made repeated raids on the camp to seize weapons.

Aid workers believe the government is desperate to close the volatile camp because its residents are sympathetic to rebel factions.

Abakr Suleiman, a tribal leader, told Reuters: "I am inside the camp Kalma. Now there is still shooting. There is heavy shooting.

"They came into the camp and killed people. There are houses burning."

Aid sources said the death toll had reached 27 with as many as 60 injured before the clashes subsided. However, estimates varied wildly and there has not yet been any independent verification of the figures.

Ameerah Haq, United Nations humanitarian co-ordinator, said she was concerned about the reports. "Such actions severely threaten the safety and security of civilians who have a right to protection under international humanitarian law," she said.

"The United Nations urges restraint and calls for the immediate establishment of a humanitarian corridor so that the injured may be evacuated."

An official with the joint United Nations and African Union peacekeeping force said a patrol was on its way to Kalma, close to Nyala, the capital of South Darfur.

More than 200,000 people have died during five years of conflict with a further 2.5 million forced to flee their homes. Many now live in sprawling aid camps which have grown to the size of cities. They are supposed to offer a haven from the violence but many are riddled with violence.

Kalma is known as one of the biggest and most volatile. It houses a mishmash of Darfur's tribes who frequently organise against each other. The camp is awash with guns and armed factions. As a result, humanitarian agencies are wary of operating among its simple lean-tos and often withdraw their staff altogether.

Yesterday, a rebel commander said the attack was part of an attempt to close the camp and disperse its residents to remove a centre of dissent.

"This morning security forces surrounded Kalma camp and demanded that every IDP (internally displaced person) leave," said Ahmed Abdel Shafie, a commander in the rebel Sudan Liberation Army. "Later, they opened fire on the eastern side of the camp. There were many casualties."

The Sudanese president, Omar al-Bashir, denies accusations that his forces are engaged in genocide in Darfur.

Judges at the International Criminal Court are currently considering whether to issue a warrant for his arrest.

Last month the court's prosecutor lodged evidence on 10 counts of genocide, murder and crimes against humanity.

Since then President Bashir has launched a diplomatic campaign building support to block any indictments. The African Union and Arab League have both warned against sending the Sudanese leader to The Hague to face trial, saying it could hinder attempts to find peace.

Djibril Bassole, a new joint mediator appointed by the UN and AU, was due to arrive in Khartoum last night as part of the latest move to try to end the conflict.

Violence in Darfur began in 2003 when rebel groups complaining of discrimination against black Africans began attacking government targets.

FOR years Father Brian Spillane presided over a flock of young, impressionable boys at St Stanislaus College in Bathurst.

A chaplain and a teacher, he officiated at school Masses, led the pupils in prayer and gave them religious guidance.

According to allegations by 13 former students, he also repeatedly raped them.

"The first time I met Father Spillane he was very 'touch e feel e' (sic) type person, he was always putting his arms around me," wrote an alleged victim in a blog he used to expose what he called an "evil pedophile ring".

That former pupil, who completed year 7 at the Catholic boarding school in 1986 before being expelled, blew the whistle on 65-year-old Spillane's alleged sex offences.

The allegations are the latest in a string of abuse scandals to rock the Catholic Church.

The school says it first became aware of the allegations five years ago when it was contacted by the same alleged victim. The allegations were forwarded to Bathurst police, who sent the information to the NSW Police's child protection and sex crimes squad.

It is not known what became of that investigation. But in August last year Bathurst police set up Strike Force Heador to investigate the claims of abuse by Spillane and two other staff members.

The investigation was a watershed moment for the whistleblower, who has been diagnosed with post-traumatic stress disorder and has spent time in psychiatric care.

Last month police executed search warrants at the school relating to two former priests, one of whom is believed to be Spillane, and a lay teacher.

Four other former pupils came forward to allege abuse and police have charged Spillane with 33 offences.

The charges include six counts of sexual intercourse with pupils aged 11, 12 and 13, and 18 counts of engaging in and inciting to commit acts of gross indecency. The other charges relate to sex with males aged between 10 and 16.

AN ITALIAN priest who planned to hold the world's first beauty contest for nuns has decided to cancel the pageant after complaints. Fr Antonio Rungi wanted to host the Miss Sister Italy contest to end the stereotype of nuns being old and dour.

He wanted to hold the contest on his internet blog but changed his mind after the local religious authorities expressed their displeasure. "Do you think that all nuns are old and sad? It is not like that any more," read Fr Rungi's advert in an Italian newspaper prior to the cancellation.

"My superiors were not happy," Fr Rungi said from the town of Mondragone, near Naples. "The local bishop was not happy, but they did not understand me. It was interpreted as more of a physical thing. Now, no one is saying that nuns can't be beautiful, but I was thinking about something more complete."

Fr Rungi insisted he never intended to put sisters on the catwalk and wanted only to highlight that they were "above all women and beauty is a gift from God".

In Bulgaria, a priest has been placed under police surveillance because of a field of cannabis he claims is a gift from God and nothing to do with him.

Fr Cyril Papudov has been arrested seven times but police have never caught him actually cultivating the crop.

"There has been a great deal of suspicion over the years about what is going on with these plants," said a police source. "He is a man of the cloth and so a lot of people don't want to think badly of him, but frankly, if someone has a huge crop of cannabis in their back garden it's highly unlikely they are just sitting there admiring its horticultural properties."

Cows automatically point north because they have their own in-built compasses, say scientists.

Their ability to find north is believed to be a relic from when their ancestors needed an accurate sense of direction to migrate across the plains of Africa, Asia and Europe.

Dr Sabine Begall and colleagues from the University of Duisburg-Essen looked at thousands of images of cattle on Google Earth in Britain, Ireland, India and the USA.

"We conclude that the magnetic field is the most likely factor responsible for the observed alignment," the scientists wrote in an article in the Proceedings of the National Academy of Sciences journal.

A Ryanair plane was forced to land in Germany after a jar of mushroom soup in an overhead locker started leaking. It dripped on to a passenger who was severely allergic to mushroom soup.

His neck reportedly swelled up and he struggled to breathe, forcing the Budapest-Dublin flight to divert to Frankfurt Hahn airport for medical help.

A four-year-old cat called Bonny has survived after being walled in beneath a bathtub for seven weeks. "It's a miracle," said Monika Hoppert, a 60-year-old widow from the western German town of Stadthagen. "I think she must have had a guardian angel. I'm so happy."

Bonny disappeared on June 19th while workmen were replacing pipes in the block of flats where Ms Hoppert lives. The black cat was last seen in a neighbouring apartment, just before the cladding around a bathtub was resealed.

When found the cat's weight had dropped from six kilograms to two kilograms. "She's almost back to normal now," said Ms Hoppert.

Ex-Palestine youth pastor arrested on sex charges

MABANK — First Baptist Church of Mabank youth minister Joshua Neal Ponder, 32, was arrested Aug. 13, for sexual assault of a teenager.

Mabank Police Chief Kyle McAfee said Ponder confessed to charges related to a 16-year-old male victim.

The assault allegedly occurred April 8 but was not reported until Aug. 8, according to reports.

The teenager is not a member of the church.

The Rev. Brent Tucker of First Baptist Church of Mabank, Chairman of the Deacons Randy Teague and Minister of Music Chris Sweet conducted a press conference at the church Thursday. The three released a statement on behalf of the church.

“We are deeply saddened by the circumstances that involve Josh Ponder prior to and during his employment at FBC Mabank,” the statement read. “We lift up in prayer his family and those who have been affected. The FBC Mabank does not condone these alleged actions. ...

“We have accepted the resignation of Ponder effective Aug. 14. We are in prayer for our youth and their parents at this time.”

Prior to his stint in Mabank, Ponder served as youth minister at First Baptist Church of Palestine from June 2001 to May 2007.

The Rev. Jay Abernathy, pastor of First Baptist Church of Palestine, was notified of Ponder’s arrest late last week and said the church would cooperate with police in the investigation, if asked.

“We are shocked and saddened by this incident, and are praying for everyone involved,” Abernathy said Monday afternoon. “We have made counselors available to our youth and families who may be hurting and will be available to anyone in our church and community who wants to talk.

“We are working to respond to everyone hurt by this.”

Representing the Palestine church’s deacon ministry board, Steve Jenkins mirrored Rev. Abernathy’s sentiments in a statement made by phone Monday.

“As a church, we are saddened by the news of (Josh’s) arrest,” Jenkins said. “We are thankful for the prompt response of the Mabank Police Department and will assist them in any way possible to see that justice is served.

“We respect the need for privacy and healing in the lives of those affected and pray that others will also.”

Ponder remains in the Kaufman County Law Enforcement Center charged with sexual assault of a child. Bail has been set at $200,000.

Mabank police are investigating possible instances of improper contact with other victims.

Kosovo Serbs without drinking water

Restrictions of the regional waterworks that is under control by Kosovo Albanian separatists has left the Kosovo Serb enclaves in Gracanica, Susica and Novi Badovac where some households have been without drinking water for 20 days.

Serbian Ministry for Kosovo-Metohija says that it is following the situation and that is has managed to increase deliveries of water for technical use but not for drinking.

50 militants killed in surging Bajaur clashes

* Officials say dead include ‘important commanders and foreigners’


KHAR: Troops killed up to 50 militants including foreign fighters in the Bajaur tribal agency on Wednesday, amid an upsurge in Taliban-inspired bloodshed, security officials said.

In the most serious incident, troops rained fire from guns and artillery on militants holed up in a health centre, killing 30 and wounding many more, military spokesman Maj Murad Khan told AP.

“Security forces killed 25-30 militants, including some important commanders and foreigners in Bajaur’s Raghan region,” a security official told AFP.

Security forces assessed the toll with the help of intercepted radio traffic among the insurgents, Maj Murad said, but spokesmen for the militants could not be reached to confirm the report.

In another clash on Wednesday, helicopter gunships and aircraft pounded militant hideouts in Loyesam, Charmang and Ghonday areas of agency headquarters Khar, and Rahgan, Aupusht and Dherai area of tehsil Salarzai, killing eight rebels and wounding 12 others, other security officials said.

Police said eight militants died and 10 were wounded when government forces fired on suspect vehicles in two areas of Bajaur early Wednesday, though the reported casualties could not be verified independently.

According to witnesses, fresh military reinforcements have arrived in Nawagai tehsil of Bajaur.

Shops, schools and business and commercial centres in the agency remained closed.

Troops are engaged in bloody offensives against extremists in the region –considered a launchpad for Taliban operations into neighbouring Afghanistan. Officials say hundreds of militants have died in the weeks-old operation, while residents say civilians have also been killed. About 200,000 people have fled to safer areas. staff report/agencies

Cong threatens Patnaik against ‘Constitutional measures’

New Delhi, Aug 28: The Congress today said the Centre has the "Constitutional measures" to protect the people in Orissa and asked Chief Minister Naveen Patnaik to act fast in restoring normalcy in the state.

"The Central government is keeping a close watch... Measures of the Constitution are available. If the state government fails to protect the people, it is for the government to examine", chief of Congress' media department M Veerappa Moily told reporters here.

Noting that the situation in the state has assumed serious dimensions, he said "Naveen Patnaik has to act to control law and order. Even the Pope has now reacted to the situation."

Moily alleged the Sangh Parivar and its affiliates were targeting minorities and said it was the duty of the state government to protect them.

Moily also came down heavily on the BJP ministers in the Patnaik government and said they should be sacked for pressuring the chief minister on the issue.

He linked the Kanpur situation with that of Orissa and hinted that such acts have to be checked.

Referring to the alleged involvement of Bajrang Dal activists in making bombs in Kanpur, Moily said, "a day will come when such organisations will have to be banned".

Italy urges India to clamp down on religious violence

ROME : A day after the Vatican condemned the violence against Christians in Orissa, Italy said it has decided to summon the Indian ambassador here to stress the need for "decisive action" to prevent and crack down on religious violence in India.

The message to be delivered to India's envoy is "the strong expectation of the government for decisive, preventative and repressive action on the part of Indian authorities" against acts of "unacceptable violence," said a statement issued following a cabinet meeting.

On Wednesday, Pope Benedict XVI "firmly condemned" the violence in Orissa and called upon religious and civil authorities "to work together to restore peaceful co-existence and harmony between the different religious communities."

"While firmly condemning the attacks on human lives, whose sacred character must be respected by all, I extend my spiritual comfort and solidarity to the monks and nuns who have been put through such a difficult test," he had said.

Islamabad - Government forces killed 23 militants in three separate clashes while eight people, most of them policemen, were killed Thursday in a roadside bombing in Pakistan's restive North- West Frontier Province (NWFP), officials said. "Gunship helicopters targeted a vehicle carrying seven miscreants in Koza Bandi area of Kabal in Swat valley. All of them died in the action," said military spokesman Major Murad Khan.

"Fifteen more were killed when security forces hit a militant hideout in the same area. Numerous people were injured," he added.

Separately, the law enforcers stopped a suspect vehicle at a security check post in Bara Bandi are in the Kabal sub-district. A burqa-clad person came out and tried to reach the security personnel who after some warning shots opened fire.

Later on, it was discovered that a militant was disguised as a female. His other comrades in the vehicle managed to flee after a brief exchange of fire, said Major Murad.

Swat has seen resurgence of violence in recent weeks where the followers of a radical cleric Maulana Fazlullah are waging a war against the government forces for the enforcement of Taliban rule in the scenic valley, formerly a tourist destination in NWFP.

Meanwhile, eight people, including seven policemen died when a roadside bomb struck a police bus in Bannu district of the province.

"Suspected Islamist militants detonated a remote-controlled explosive device when the prison van was crossing a bridge over the Kurram River, killing six policemen and a passerby," a senior police officer, Waqas Hasan, said.

One injured policeman on succumbed to his injuries later in the day.

Hasan said the blast was so intense that it threw the police vehicle off the bridge and onto the dry riverbed. The explosion also blew a gaping hole in the concrete bridge, he said.

The bus, which was carrying only law enforcement officers, was going to a local prison to transport defendants on trial from the detention facility to courts.

A security officer in the area suspected the attack was carried out in revenge for offensives launched by the government against militants in Pakistan's north-western regions.

"Militants from the tribal areas are now increasingly taking vengeance on security forces," the officer said.

The military said Wednesday that its forces killed around 50 insurgents during clashes in different tribal districts near the Afghan frontier.

Bannu borders the North Waziristan tribal district, a sanctuary of pro-Taliban militants, including foreign fighters, and it has seen several recent deadly attacks on police and military targets.

Suspected militants bombed a bus in northwest Pakistan on Thursday, reportedly killing eight people, as protesting lawyers blocked roads across the country in an effort to press the government to reinstate judges purged by former president Pervez Musharraf.

The car bomb exploded in the middle of a long, concrete bridge near the city of Bannu, leaving a large crater.

The bus, which was travelling across the bridge at the time, smashed through a railing on the side of the bridge and tumbled about nine metres into a mostly dry riverbed below.

The bus was en route to a prison to pick up several inmates, said local police chief Jalil Khan.

Seven policemen and an education department official who had hitched a ride were killed, he said.

While there was no immediate claim of responsibility, police said militants were the likely culprits.

Hours earlier, security forces drove off a Taliban attack on a fort and pounded another band of militants holed up in a health centre, officials said Wednesday as fighting spread to new areas in the tribal belt along the Afghan border.

As many as 49 insurgents were reported killed in separate attacks.

More than 200 people have been killed in a cycle of bombings and clashes since longtime U.S. ally Pervez Musharraf quit as president on Aug. 18 to avoid impeachment by the coalition government that triumphed in February's elections

His resignation, nine years after he seized power in a military coup, has caused widespread political and social turmoil.

A week after his departure, the country's second-biggest party, led by former Prime Minister Nawaz Sharif, pulled out of the coalition over its failure to restore judges purged by Musharraf last year.

Lawyers renew protests
Meanwhile, lawyers who agitated for more than a year in favour of the judges and against Musharraf led new protests against the government Thursday.

Several thousand demonstrators blocked roads in a string of major cities.

They also chanted slogans against Asif Ali Zardari, Bhutto's widower and the favorite to replace Musharraf when lawmakers select a new president on Sept. 6.

Protesters destroyed posters of Zardari in Islamabad, and held similar demonstrations in Karachi, Rawalpindi, Quetta and Peshawar, reported Reuters news agency.

However, their numbers were smaller than in the past and Sharif's supporters largely stayed away.

The turmoil has left the main ruling party, once led by slain former prime minister Benazir Bhutto and now succeeded by Zardari, in a position to dominate the government.

U.S. pressures Pakistan on militant action
U.S. officials have been pressing for more action against insurgent strongholds in Pakistan's wild border region, but Pakistan's military insists it is doing what it can to contain militants and prevent them from moving against NATO and Afghan troops on the other side of the border.

There are also 2,500 Canadian troops stationed in Afghanistan, mostly in the southern Kandahar province.

Pakistani army chief Gen. Ashfaq Parvez Kayani met Adm. Mike Mullen, chairman of the U.S. Joint Chiefs of Staff, and other top American commanders Tuesday to discuss security strategy "in an open and cordial manner," a military statement said.

The gathering was scheduled, it said, but gave no further details.

The New York Times reported that the meeting took place on a U.S. aircraft carrier in the Indian Ocean and focused on co-ordinating counter-insurgency efforts along the Pakistan-Afghan border.

Pakistani officials have sought peace agreements in the border region in hopes of curbing Islamic extremists who have been blamed for a wave of suicide attacks across the country in the past year.

The Pakistani Taliban, meanwhile, are becoming increasingly bold, claiming responsibility for a wave of suicide bombings and gun attacks.

The main ruling party, the Zardari-led Pakistan People's Party, has been hardening its stance on Islamic extremists.

KABUL, Afghanistan (AP) — A four-day battle that began with an ambush on a joint U.S-Afghan patrol in southern Afghanistan has killed more than 100 militants, the coalition said Thursday.

Militants wielding rocket-propelled grenades, guns and mortars attacked the joint patrol in the southern province of Helmand multiple times starting Monday, the coalition said. The combined force called in fighter aircraft for support.

Capt. Scott Miller, a coalition spokesman, said he couldn't provide further details, including a more precise location of the fighting, because the battle was continuing.

The coalition statement said no Afghan, coalition or civilian casualties had been reported.

The large death toll comes about one week after the U.S. said it killed 25 militants and five civilians during an operation in the Shindand district of Herat province. Afghan officials, however, say between 76 and 90 Afghan civilians were killed in that operation last Friday. The U.S. is investigating and plans to make its findings public.

Claims of large death tolls made either by international forces or Afghan officials are almost impossible to independently verify because of the remote and dangerous locations of the battles.

Meanwhile, a roadside bomb killed a U.S. coalition soldier in southern Afghanistan on a patrol Wednesday. Neither the nationality of the soldier nor the location of the attack was released.

In the Nad Ali area of Helmand province, a fight between police and militants killed 14 insurgents late Wednesday, said Daud Ahmedi, the governor's spokesman.

More than 3,700 people, mostly militants, have died in insurgency-related violence so far this year according to an Associated Press tally of figures provided by Afghan and Western officials.

Swat militants’ positions shelled

MINGORA, Aug 27: Fresh tension gripped the Swat Valley after militants blew up four private transport offices at the Matta general bus stand and security forces, backed by helicopter gunships and artillery, shelled suspected militant hideouts on Wednesday.

The transport offices which run and regulate Karachi-bound coaches were blown up on Tuesday night. However, no casualty was reported because the transporters had vacated the offices several days ago.

The explosions caused by devices planted by militants destroyed the offices.

The security forces pounded suspected militant positions with mortar and shells in upper areas of Kabal, Barikot, Matta and Charbagh tehsils from the Frontier House of Kabal and the FC camp in Kanju early on Wednesday. Several houses were damaged when some shells fell in residential areas. However, there was no report of any casualty.

Meanwhile, hundreds of people were continued to leave their homes and moving to safe places in the district and other areas of the province.

Priest pleads guilty to child sex charges

A Catholic priest from the Melbourne archdiocese has pleaded guilty to 10 child sex and pornography charges in the County Court.

Father Edmund John Haines, 62, served the district near Geelong for 12 years, including the towns of Meredith, Winchelsea, Anakie and Bannockburn.

The Geelong resident, who is known by his middle name, pleaded guilty to six counts of committing an indecent act with a child under 16, committing an indecent act with a child aged 16 or 17 who was under his care, procuring a child to make pornography, and producing and possessing child pornography.

Haines was also a chaplain at St Joseph's College in Geelong and had worked as a priest in Papua New Guinea.

In 2005 he presided over the Winchelsea funeral for three children killed by their father, Robert Farquharson, after he deliberately ran off the Princes Highway and into a dam.

Prosecutor Susan Penhall said the offences took places between March 2006 and February 2008.

The Hamlyn Heights resident was arrested in mid-February 2008 when police seized images of children from his home.

The court heard these included seven videos and 30 photographs of child pornography.

The search followed a complaint from a member of the public in Colac.

After his arrest the Catholic Archdiocese placed Haines on administrative leave and withdrew his right to minister as a priest.

At the time Catholic Archbishop Denis Hart said he was deeply troubled by the charges and assured parishioners of his concern for them.

When asked in court what his occupation was, Haines paused and then replied "priest''.

He was bailed to appear in late October.

The principal of an Islamic boarding school on Buffalo’s East Side has been forced to resign after allegations that he was sexually involved with one of his students and that he claimed to have taken her as a second wife.

Evidence suggests Mohammed Ibrahim Memon, a father of seven, persuaded Sajidah Khan, then 21, to marry under Islamic law as a pretense to sleep with her.

Memon, an Islamic scholar and imam, has agreed to leave his post at Darul-Uloom Al-Madania, 182 Sobieski St., for a minimum of seven years. The private, Islamic secondary school and institute of higher learning is located alongside Masjid Zakariya mosque in the Broadway-Fillmore neighborhood.

Memon also agreed to never teach in the girls school again if reinstated.

Dr. Khalid J. Qazi, president of the local chapter of the Muslim Public Affairs Council, expressed disappointment over Memon’s “inappropriate and intimate relationship.”

“Parents have trusted their best assets, their children, to Imam Ibrahim, and he has broken that trust,” Qazi said.

Mixed views expressed

“We were betrayed,” said Chaudhary A. Khan of Woodbridge, Va., Sajidah’s father, who has sent four children to Madania.

“I want families to know these people are not following Islamic laws, they are not following American laws. They claim they are serving Islam, but they are just serving themselves,” he said.

At issue is Memon’s relationship with Sajidah Khan, now 23.

Khan says Memon proposed to her at school in August 2006, and proclaimed within days he had married her himself, under Islamic law, with two witnesses present. He also told her to keep their marriage secret.

Interviews with several Muslims reveal a mixed view on additional marriages under Islamic law. Some said it is not allowed under United States law and therefore is forbidden; others said it can be permissible under Islamic law anyway. Even so, there are several steps required for an Islamic marriage to be recognized, and the description of Khan and Memon’s marriage violates those tenets.

Memon denies marrying or engaging in physical contact with Khan. He claimed to The Buffalo News only to have listened to Khan’s problems over the telephone when he should have referred her to her father.

However, Qazi said Memon signed an agreement admitting “intimate, clandestine and highly inappropriate” relations with Khan from August 2006 to July 2008.

Memon did so at an Aug. 17 meeting organized by local Islamic leaders and Khan’s family. It was held in Johnson City, west of Binghamton, to accommodate three school donors.

Memon, a 40-year-old married father of seven who has helped run the school since 1991 with his father, the school’s founder Ismail Memon, offered oral and written apologies along with his resignation.

The agreement also calls for the appointment of an independent board to oversee the school.

Sajidah Khan, observing strict rules of separation between the sexes, was relegated to listening from the next room.

Darul-Uloom Al-Madania consists of a complex of brick buildings, along with Masjid Zakariya, a former church cathedral.

Because interaction between the sexes is forbidden under Islam until marriage, girls and boys are not allowed to be in the same classroom or have outside contact.

When girls are taught by male teachers, they must listen in another room.

Khan attended the girls secondary school through 10th grade. She continued her studies with a five-year program leading to a certificate of Islamic scholarship in 2006.

Imam denies marriage

It was in her last year of study, Khan said, that Memon sought her out. Khan says he arranged a secret meeting on Aug. 30, 2006, in the locked basement of a heating room.

Khan said the imam flirted with her, and she had to repel him when he tried to have physical contact. That day marked the first time he talked of marriage, she said.

Until that day, Khan said, she could count the social contacts she had had with males on one hand.

“In our culture, we don’t even let girls sit with their male cousins, and this guy is a teacher. Why is this man, who has said we are not even allowed to chat with a boy, doing this?” she said.

“At the same time, I’m thinking, ‘He is a teacher, he is very famous, maybe he knows something I don’t know.’ ”

Memon persisted with marriage requests. Khan says after she agreed, Memon told her he had finalized their marriage the next day, Sept. 8, in her absence.

Memon insisted she tell no one, including her parents, Khan said.

She returned home to live with her parents in a Virginia suburb, but schemed with Memon for meetings near her home and in Buffalo.

Khan said Memon was always concerned about covering his tracks so their relationship wouldn't be detected, although Memon's wife, Mariam, approved.

She was surprised to hear the educator make dismissive comments about the girls who studied at Madania, and "often said women were [on Earth] only to satisfy men."

Chaudhary Khan, Sajidah's father, said Memon eventually admitted marrying his daughter, but wouldn't send a marriage contract to confirm it. Later, the father said Ismail Memon told him his son divorced Sajidah in a ritual involving Memon family members.

The family's decision to go public occurred after two prominent Pakistan imams, Mufti Rafi Usmani and Mufti Taqi Usmani, told Sajidah Khan's brother, Ikram Haq, that the family had an obligation to speak up and inform other Muslims of what happened.

A former Madania teacher who requested anonymity said it's rare for an Islamic family to speak up in such circumstances.

"Within the Islamic community, the family has such a high status that everyone is worried about compromising one's honor and dignity. People are also afraid to give Islam a bad name, especially in the current climate."

A former Madania student, who wished to remain anonymous, also told The News she had a relationship with Memon several years ago as a student. Days after accepting his marriage proposal, she said, Memon told her he married them both in front of two witnesses she came to believe never existed.

Also, like Khan, the former student said Memon told her not to tell anyone. But she did, and soon her father removed her from the school. The woman no longer believes she was married to Memon, and is bitter toward the school and its teachings.

"When I talked to [the former student], we realized it was almost the same story for both of us," Khan said.

Khan currently attends a community college in Virginia, and plans to marry, with her parents’ blessing, in October.

Meanwhile, Memon, author of “The Book of Purification,” denies being romantically involved with Khan.

“As far as marriage and divorce, that has never been there. Not even Islamically, not even from the religious point of view,” Memon said.

Later, he said, “[Marriage] is just a term that we were using, but we were never considering it a marriage, really. Even she knows.”

Apartment in question

Asked for further explanation, he said he was at fault for not referring Khan’s phone calls to her father. “If you take the Islamic perspective out, then you would see nothing really wrong there,” Memon said.

Memon also denied being involved with renting short-term apartments Khan stayed in. However, Patti Boal, manager of Corporate Manor Apartments, 303 North St., tells a different story.

Boal says she rented apartments with monthly leases twice in 2007 and once this past February under Khan’s name. She said she saw Memon during that time “at least four or five times,” and he always paid in cash.

“I remember him saying the first time, ‘I’m renting this for my wife, and she will be here at a later date to pick up the keys,’ ” Boal said.

Memon’s signature also appears on a lease dated Jan. 6, 2008. And he listed the return address for a security deposit as 40 Parker Ave., Boal said, the address of Masjid At-Taqwa, a mosque where Memon presides as imam.

Afghan President pardons men convicted of bayonet gang rape

The Afghan president, Hamid Karzai, has pardoned three men who had been found guilty of gang raping a woman in the northern province of Samangan.


The woman, Sara, and her family found out about the pardon only when they saw the rapists back in their village.

“Everyone was shocked,” said Sara’s husband, Dilawar, who like many Afghans uses only one name. “These were men who had been sentenced and found guilty by the Supreme Court, walking around freely.”

Sara’s case highlights concerns about the close relationship between the Afghan president and men accused of war crimes and human rights abuses.

The men were freed discreetly but the rape itself was public and brutal. It took place in September 2005, in the run up to Afghanistan’s first democratic parliamentary elections.

The most powerful local commander, Mawlawi Islam, was running for office despite being accused of scores of murders committed while he had been a mujahedeen commander in the 1980s and a Taliban governor in the 1990s, and since the fall of the Taliban in 2001. Sara said one of his sub-commanders and body guards had been looking for young men to help in the election campaign.

“It was evening, around the time for the last prayer, when armed men came and took my son, Islamuddin, by force. I have eye-witness statements from nine people that he was there. From that night until now, my son has never been seen.”

Dilawar said his wife publicly harangued the commander twice about their missing son. After the second time, he said, they came for her. “The commander and three of his fighters came and took my wife out of our home and took her to their house about 200 metres away and, in front of these witnesses, raped her.”

Dilawar has a sheaf of legal papers, including a doctors’ report, which said she had a 17mm wound in her private parts cut with a bayonet. Sara was left to stumble home, bleeding and without her trousers.

When I met the couple in May 2006, they were in hiding and struggling to pursue the four men through the courts, petitioning the parliament, the president, human rights organisations and the United Nations. Sara and Dilawar say that one of the men involved in the attack used money and connections to repeatedly evade justice, particularly after his boss, Mawlawi Islam, became an MP and, they allege, was fully able to protect him.

In January 2007, Mawlawi Islam was assassinated. However, the other three men accused of the gang rape were put on trial, found guilty and sentenced to 11 years in prison. Abdul Basir died in jail. The other two rapists, Nur Mohammad and Kheir Mohammad, were released last May. The commander was found not guilty.

A copy of the pardon was numbered, dated in May and appeared to bear the personal signature of Hamid Karzai. It recommended the men’s release because, it said, “they had been forced to confess to their crimes.”

When showed copies of the presidential pardon and court papers, President Karzai’s spokesman, Hamayun Hamidzada, was visibly shocked and said that if the documents proved genuine, Mr Karzai would be “upset and appalled.”

He said it was impossible that President Karzai could knowingly have signed a pardon for rapists, but refused to speculate on how the pardon could have come about. He promised an investigation into all aspects of the case, including the - as yet unsolved - mystery of Sara’s missing son.

He denied that there was one law for the rich and well-connected in Afghanistan and another for people like Sara. “There are difficulties - we’re rebuilding institutions, including our justice institutions and there are shortcomings, but the president and the government are committed to the rule of law on all equally.”

A UN human rights official said that, although she could not remember a similar case of the president giving a pardon in such a serious case, corruption in the police and courts was endemic.

The MP, Mir Ahmad Joyenda, said cases similar to Sara’s were actually becoming more common. The police and the courts, he said, were usually under the sway of local commanders. “The commanders, the war criminals, still have armed groups,” he said. “They’re in the government. Karzai, the Americans, the British sit down with them. They have impunity. They’ve become very courageous and can do whatever crimes they like.”

Sara and Dilawar are again in hiding, having felt too vulnerable to stay in their village. Dilawar was prepared to discuss the case. In Afghanistan, speaking about rape means risking further dishonour, but when asked whether he minded Sara’s story being publicised, Dilawar said, “We’ve already lost our son, our honour, we’ve sold our land to pay for legal costs and we’ve lost our home – what else can we lose?”

Frontpage Interview's guest today is Moorthy Muthuswamy, an expert on terrorism in India. He grew up in India, where he had firsthand experience with political Islam and jihad. He moved to America in 1984 to pursue graduate studies. In 1992, he received a doctorate in nuclear physics from Stony Brook University, New York. Since 1999 he has extensively published ideas on neutralizing political Islam's terror war as it is imposed on unbelievers. He is the author of the upcoming book, Defeating Political Islam: The New Cold War.





FP: Moorthy Muthuswamy, welcome to Frontpage Interview.


Muthuswamy: Thank you for this timely interview, Jamie


FP: There were some Islamic terror attacks against India in late July. What do you make of them?


Muthuswamy: The late July 2008 blasts are ominous signs of a political Islamic movement in India coming of age. This movement is a consequence of a thirty year old process of jihadization of Indian Muslims or simply, jihad build up in India.


The Islamic conquest of nations and people in Arabia and Africa is now part of history. We are now witnessing the Islamic conquest of South Asia. With Pakistan and Bangladesh firmly Islamized, now the attention is shifting to India, the last big land of South Asia yet to be conquered.


Who would have thought that this barbaric conquest phenomenon will rear its ugly head again in our life time?


FP: Can you give some background to the readers?


Muthuswamy: Sure.


Studies of Islamic conquest of non-Muslims and their land have identified a process called jihad build-up in non-Muslim nations. This build-up also creates what is called a political Islamic movement.


In this process the Muslim minority is systematically and politically indoctrinated by mosques aided by funding from Muslim majority nations, on the grounds of "religious freedom". This indoctrination is geared towards driving Muslims away from the mainstream, to become hostile to their own nation, and to identify with pan-Islamic aspirations, including a unified Caliphate under Sharia. The Caliphate is envisioned to wage wars until the whole world is converted to Islam.


The contiguous land mass of the Caliphate requires destroying India and converting it into an Islamic state – the primary goal of the political Islamic movement in India. Spearheading this effort in India is the Student Islamic Movement of India (SIMI), identified by Indian intelligence as the terror outfit behind the serial blasts of late July, 2008.


Here is what one may call as a well-articulated manifesto of the Call to Arms (armed jihad): click here. This manifesto was sent minutes before one of the serial blasts and it warned of impending blasts to note that Hindu blood is, "the cheapest of all mankind" and contained Koranic justifications for killing unbelievers. Of course, the manifesto also called on the Hindu majority in India to embrace Islam in order to avoid further attacks – a chillingly similar threat Bin Laden and his deputies' issue to America every now and then.


FP: What is the ideological inspiration and cover for SIMI?


Muthuswamy: It is mostly derived from Deoband Islamic seminary and the tens of thousands of clerics it has graduated over the years. Deoband is an Indianized version of Wahhabism established in the 19th century (most terrorist outfits in Pakistan, Taliban or even many in ISI, the Pakistani intelligence agency, are considered its followers). A declaration issued at the end of February 2008 "anti-terror" conference organized at Deoband showed Islamic deceit or Taqqiya at its very best – "Their [western] aggression, barbarism and state-sponsored terrorism – not only in Palestine, Iraq and Afghanistan, but also in Bosnia and various South American countries – have surpassed all records known to human history."


The declaration said nothing about Pakistani and Saudi sponsorship of terror in India or Indian Muslims' role as foot-soldiers of this jihad. Among the main thrust of this conference was to give a clean chit to SIMI and to absolve it of any terrorism related activities carried out in India.


Ironically, the Indian government too has unwittingly acted to nurture the intellectual base of jihad and sponsorship of SIMI, through an increasing number of government-funded universities with "Muslim character" – Aligarh Muslim University, Jamia Millia Islamia University, to name a new.


FP: Can you talk about the serial blasts themselves?


Muthuswamy: The back-to-back serial bomb blasts that killed many and injured scores of innocent civilians in the Indian cities of Bangalore, Ahmedabad, and detection and diffusion of scores of other bombs in Surat in July 2008 may have signaled the next stage of jihad build-up in India – from siege to attack mode. Bangalore was probably chosen due to its prominence as the emerging technology capital of India; the city of Surat in Gujarat is the diamond business center of India and Ahmedabad is the capital of the Indian state of Gujarat – the engine driving India's economic growth and whose population is most resistant to jihad.


From the strategic point of view of destroying Indian economy and degrading the will of the unbelievers to resist, and to destabilize India, no other targets could be better chosen.


These blasts show exceptional levels of organizational ability, inspiration, logistical support in both men and material, and importantly, wide following of extremism among Indian Muslim population. I believe that Indian jihadists and their sponsors in many Muslim nations have concluded that due to the extensive network of terror cells established in Muslim communities all over India they can now indefinitely bleed India until it is destroyed. I also think that the Indian jihadists have shown only a small measure of what they are capable of.


Unlike most western nations where state monitoring of mosques and other jihad sponsoring entities is good (especially since 9/11 attacks), in the case of India, a retired top intelligence official has noted very limited penetration of terrorist entities by the state. Due to this reality, Indian intelligence has no clue about the full dimension of terrorist threat India faces.


Unsurprisingly, military pressure on India is now mounting on its western front, with frequent reports of gun fire exchange with Pakistan and breaking of the four year old ceasefire. As the Indian army is increasingly diverted to quell Muslim-Hindu fight within India, Pakistan is expected to infiltrate more of its irregular jihadists and troops disguised as "freedom fighters" in order to help "oppressed" Indian Muslims to take the war inside India.


The excitement of a resurgent India is fast getting replaced with India as a theater of jihad.


FP: American intelligence officials have gathered intelligence suggesting that Pakistan helped plan the deadly bombing of India's embassy in Afghanistan. What do you make of this?


Muthuswamy: Indeed, there is every bit of motivation for Pakistanis to plan and execute the Embassy bombing. Pakistanis see India as their primary enemy and clearly, they couldn't digest increasing Indian influence in what they see as a Pakistani sphere of influence.


This bombing puts a damper on developmental efforts in Afghanistan. When you add this to the Pakistani support and sponsorship of the Afghan Taliban, the American effort to stabilize and to moderate Afghanistan is running into some serious difficulties.


In addition, aided by Saudi Arabia, even under Musharraf, Pakistan has continued to destabilize India.


It seems, American effort to engage Pakistan has yielded very little on the larger strategic front, while tactically it may have been successful in capturing some Al-Qaeda operatives.


Jamie, as you may recall, in an earlier interview conducted last year, I had mentioned that, "[t]he de facto power in these nations [Pakistan and Saudi Arabia] are political Islamic movements, this makes these leaders ineffective in stopping these nations from being fountainheads of terror."


Pakistani military and ISI are the sword-arm of political Islam in Pakistan. First and foremost, they will never stop armed jihad – and no other internal force can change that.


Even Musharraf showed his true colors by coming to the aid of the ISI, by calling it: "the first defense line of Pakistan."


Pakistan has now become one of America's biggest foreign policy and strategic challenges. The bottom line is that America has little leverage against Pakistan (or Saudi Arabia for that matter).


A desperate India and frustrated America will be increasingly pulled toward each other to counter Pakistan-Saudi axis in the region.


FP: What are the powers behind the jihad build-up against India?


Muthuswamy: The primary powers behind the jihad build-up in India, and the resulting terror and mayhem created there are Pakistan and Saudi Arabia.


We may be able to associate these nations and their leaders with genocide, crimes against humanity and war crimes as defined by the Geneva Convention. This is an interesting angle because it may provide the western powers much-needed leverage against these terror-sponsoring entities and also legal justification to jihad victim states to decisively strike back.


Let me present some material that might implicate Pakistan and Saudi Arabia.


Centuries ago "offensive" or "expansionist" armed jihad was used to conquer land and people for Islam. It is interesting to note the view of a Sharia judge of Pakistan who had sat in its Supreme Court for twenty years: "Even in those days . . . aggressive jihads were waged… because it was truly commendable for establishing the grandeur of the religion of Allah."


Now, with international criminal system in place, and also because many Muslim nations no longer have the military might to impose an expansionist jihad on unbeliever nations, the concept of "defensive" armed jihad has been invoked to justify arming and funding Muslim insurgencies in many non-Muslim majority nations in order to create separate homelands for Muslims.


As part of the grand vision of the so-called defensive jihad, state-sponsored Saudi charities have worked to deliberately drive a wedge between Muslim minorities and the non-Muslim majority in many nations; new mosques were established and material hateful of unbelievers was distributed and preached. These measures, funds for mobilizing the faithful and the indoctrinating the necessity of waging armed jihad have given Muslim populations a sense of empowerment, ideology, logistics, and motivation needed to mobilize and to finally wage armed jihad.


In Muslim majority nations such as Pakistan, the above process has created a steady stream of recruits for global jihad.


In other words, as we will see, worldwide Islamic terror is part and parcel of a grand vision of Saudi Arabia.


Having financed and provided logistics for the charities, the Saudi government itself provided material for indoctrination and to prepare Muslim minorities to wage armed jihad on their non-Muslim compatriots. Here is a sample of the official Saudi school material for consumption both internal and abroad:


In these verses is a call for jihad, which is the pinnacle of Islam. In (jihad) is life for the body; thus it is one of the most important causes of outward life. Only through force and victory over the enemies is there security and repose. Within martyrdom in the path of God (exalted and glorified is He) is a type of noble life-force that is not diminished by fear or poverty (Tafsir, Arabic/Sharia, 68).

Before adverse publicity compelled the Saudis to remove the following statement, the Islamic Affairs Department of the Saudi embassy in Washington carried the following statement defining the motif for jihad:

The Muslims are required to raise the banner of jihad in order to make the Word of Allah supreme in this world, to remove all forms of injustice and oppression, and to defend the Muslims. If Muslims do not take up the sword, the evil tyrants of this earth will be able to continue oppressing the weak and [the] helpless…


There is every reason to believe that the Saudis have distributed these kinds of materials around the world, including in India.


FP: Can you discuss the specific case of the Kashmir jihad?


Muthuswamy: "Self-determination" of "oppressed" or "alienated" Muslims in Kashmir is among the most popular cause (of "defensive" jihad) in the Muslim world. Pakistan and Saudi Arabia have pursued this jihad aggressively, while exposing their hand (and thereby implicating them) because they seem to think that they are dealing from a position of "moral high ground" and because India is seen as a weak state.


By the Pakistani Ambassador to the United States, admitting its role: "Jihad, insurgency or whatever you want to call it in Kashmir... Yes, Pakistan may have helped the jihad at some time, but it was not started by us".


First, I want to show that the Kashmir jihad is an offensive one aimed at extending Islam's boundaries at the expense of non-Muslims by imposing a no-holds-barred warfare on the state controlling Kashmir, India. It is ironic that Pakistan would want to grab more territory from India, especially when it owes a significant portion of its territory to India for its recent acts of non-Muslim ethnic cleansing.


Funding for building mosques and indoctrinating Muslim populations in Kashmir has been funneled through state-sponsored Saudi charities. While supporting Muslim self-determination in Indian part of Kashmir (so that the Muslims would vote to join Pakistan and take the land to Islamic Pakistan), nothing is said about non-Muslim ethnic cleansing (to India) from Pakistani part of Kashmir or from Pakistan itself (to India).


Just as India had to absorb non-Muslims driven out of Pakistani part of Kashmir and from the rest of Pakistan, Pakistan could simply absorb the Muslim population in the Indian part of Kashmir (minus the land), if they feel so alienated. And, that could be considered an equitable arrangement. But clearly that is not the case here; the principle that has been invoked is: What is mine is exclusively mine and what is yours is also mine!


In other words, Kashmir jihad is a bogus "defensive" jihad.


FP: Can you provide more details on the jihad buildup in India aided by Saudi Arabia (and assisted by Pakistan)?


Muthuswamy: I provide them below. I believe the Indian govt. has shared much more comprehensive data implicating both Pakistan and Saudi Arabia with their American and other western counterparts.


Funds for Muslim insurgencies, including Kashmir Muslim insurgency and Al-Qaeda were funneled through Saudi state-sponsored charity organizations such as Muslim World League (MWL) and World Association of Muslim Youth (WAMY). A MWL communiqué in 2000 called for, "all assistance to the people of Kashmir, and support its steadfast struggle." Since a major part of this "struggle" is armed insurgency, this call for material support and support of the "struggle" can be taken to mean supplying of funds, arms, and ammunition for an armed jihad. According to Indian government, "90 percent of the funding [for Kashmir militants] is from other countries and Islamic organizations like the WAMY".

A cursory review of over thirty years of MWL's mouthpiece, The Muslim World League Journal, indicates that it has consistently ignored expulsion of over 300,000 non-Muslim Kashmiris and Kashmir Muslim complicity toward this cleansing act. Also ignored are Kashmiri Muslims' religious apartheid practices toward non-Muslim Kashmiris and others in the rest of the state.

The key first step toward building up jihad is the construction of new mosques. Starting 1980, scores of new mosques were constructed. Since 1990s at least 3,000 new mosques were constructed in Kashmir, many with Saudi assistance.

SIMI's, "spectacular growth after 1982 lay in the support it gained from Islamists in West Asia, notably the Kuwait-based World Association of Muslim Youth and the Saudi Arabia-funded International Islamic Federation of Student Organizations."

With authorities in Saudi Arabia, Pakistan, Egypt, Libya and Sudan assisting, about $700 million was raised to further growth of Islam. As part of this plan new mosques and madrassas were to be constructed outside of Kashmir.

Indian security agencies have detailed how Saudi Arabia acts as the meeting point of Indian and Pakistani-backed terrorists who plot their strikes in the Indian Kashmir and elsewhere. Indian security officials have been unhappy with the Saudi efforts in monitoring sizable funds that are transferred to India, a big portion of which is suspected to be routed to fundamentalist institutions.

Saudi-funded mosques in Kashmir have been at the forefront of jihad against non-Muslims in Kashmir that led to over 300,000 of them driven out of Kashmir, many murdered and raped.

Saudi Arabia is also indirectly sponsoring jihad against India by, "[s]ubsidizing Pakistan's terrorism training infrastructure and ISI terrorist operations by a whole host of Islamic fundamentalist terrorist outfits against India".

In January 2006, India approached the Saudis to sign an extradition treaty covering terrorism. But Saudis demanded that India agree to incorporate "freedom struggles" as a justification of acts of violence.

Additionally, state-sponsored Saudi charities have funded India specific terrorist outfits in Pakistan, such as Lashkar-e-Taiba (LeT), who are working to create additional homelands for Muslims in India through terror. An ex-activist of SIMI claimed, "Funds are available for the asking for LeT not only from Pakistan, but also from Wahhabi fundamentalists in Saudi Arabia and the UAE".

Battling Saudi-sponsored Islamic terrorism has been an escalating burden on an impoverished India. Nearly about 6,000 children die every day in India due to malnourishment driven by poverty.


Serial blasts by suspected Islamists, in major Indian economic and technological hubs such as Bangalore and Ahmedabad are poised to drive capital and investment out of India, drive millions more into poverty and make it easier for jihadists to destroy India from within.


Also notable is terrorist attacks directed at Hindu temples – exposing the intent to annihilate the idolaters' way of life, as suggested in Koranic injunctions.


All of the available evidence appears to show a desire, intent, and execution on the part of Saudi Arabia (and Pakistan) to impose an offensive jihad on India – not just restricted to Kashmir – using bogus excuses that are either exaggerated or invented. Even the so-called alienation of Kashmiri/Indian Muslims is to a great part built up by Saudi charities in order to use Indian Muslims as foot-soldiers to purposefully extend Islamic sphere of influence at the expense of non-Muslims. This is sanctioned by the pseudo-Constitution of Saudi Arabia, the Koran and the Sunnah, which have widely quoted verses (by Muslim clerics) that justify violent conquest of unbelievers.


This deliberate, long-term, and large-scale execution of terror plans has already devastated significant portions of India, with about one hundred thousand people killed, and about half a million displaced. Besides, this highly impoverished nation had to divert its scare resources to fight this terror imposed on its people, and this has in turn led to exacerbating malnutrition of its children, their deaths as a result and grinding poverty of millions of its citizens.


Among the cross hairs of the terrorists' hit list, according the Indian Home Ministry: India's nuclear installations, power plants, and oil refineries. The current escalation of serial blasts and what is yet to come at this rate is poised to devastate and kill tens, if not hundreds of millions of Indians and take away the future of many more in the coming decades.


It appears that one can associate the pattern of terrorism waged on India, spearheaded by Pakistan and Saudi Arabia as genocide, crimes against humanity and war crimes as per the Geneva Convention. This act of genocide is of a slow form, likely taking several decades to conduct (less likely to be noticed, as a result), unlike the classic one in Darfur region of Africa which is measured in years.


By emphasizing just the "self-determination" of the Muslims in Kashmir while ignoring the ethnic cleansing of non-Muslims in Muslim majority regions nearby, leaders such as the reigning King Abdullah of Saudi Arabia and Pakistan's leadership may have set forth policy measures leading to terror, genocide and crimes against humanity conducted on the people of India, using the Saudi and Pakistani resources respectively.


FP: What can India do?


Muthuswamy: In the near-term there is little the ruling regime in India can do, as the nation awaits blasts of increasing devastation and frequency.


Internally, the tipping point may have been crossed; India no longer defendable. Jihadists know what they are doing, as a Pakistan-based jihad commander proclaimed a few years ago.


Even in the long-term, poor governing and a dysfunctional democracy significantly undermine India's prospects. Besides, the institutional know-how on dealing with the Islamic threat remains primitive, as the recent Frontpage Symposium can attest to.


Putting it differently, India is a sitting duck – and these serial blasts mark the beginning of extreme destabilizing of India: Spreading of Kashmir jihad into the rest of India.


In this war of minds, first and foremost, India has to articulate the rationale for its existence within human rights framework. Here is one.


Non-Muslims from every Muslim majority region of South Asia – without exception – be it Pakistan, Bangladesh or from India's own Kashmir valley have been massively driven out to Hindu-majority India. This occurred when Muslim populations in these areas obtained political power. In addition, in 1971, the Pakistani army selectively sought out and killed perhaps a million or more Hindus and drove many more to India. But it was never held accountable. Indeed, due to this mostly one-sided religious cleansing India ended up accommodating about 85% of the original population in about 75% of the original land called British India.


The fact that non-Muslim populations in these Muslim majority regions shared ethnicity, language, food habits, and culture didn't at all help or save them. This data shows unequivocally that South Asian Muslims do not believe in coexistence and that the Islam practiced in the region is a repressive political ideology of conquest that pretends itself as a religion.


This documented genocidal conquest of non-Muslims in South Asia compellingly defines the first human rights priority for India: Ensuring India's long-term existence as a free and safe land of opportunity for non-Muslim South Asians.


Armed by this rationale and with the right leadership India can take to the much-needed offense by first mobilizing the non-Muslim majority and to weaken jihadist hold on a mobilized Indian Muslim population.


However, the major responsibility of stopping jihad in India falls in the hands of mainly those who nurtured it all these years: political and religious leadership of Pakistan and Saudi Arabia. Besides, in the eyes of Indian jihadists, these external entities carry more weight than the internal ones.


It is only natural that the Indians make the following demands on the Saudi/Pakistani political and religious leaderships:


They apologize for their one-sided past support of "self-determination" of Muslims in Kashmir while ignoring the plight of non-Muslims driven away from nearby Muslim majority regions.

These leaders will appeal to the Indian Muslims, Pakistanis and the Saudis – and take steps to stop the jihad directed at India and its citizens.

Saudi Arabia will agree to generously fund to rehabilitate Indian Muslims away from extremism, to compensate non-Muslim Indians affected by Islamic radicals that are in anyway indoctrinated by Saudi-originated funds and to compensate the Indian state for the damages suffered and expenses occurred due to Saudi jihad.

Saudi Arabia will not stop oil exports to India, as this could be interpreted as waging additional jihad on humanity in India.

Pakistan will take the "alienated" Kashmiri Muslims from India and settle them in the portion of Kashmir it holds and in the rest of Pakistan.

Of course, one should be under no illusion that any of these demands are going to be made by the Indians any time soon or even if they are made, the Saudis and Pakistanis are willingly going to embrace them!


Yet, if India wants to exist and do so securely, it has little choice.


These are first of the steps India has to undertake in order to persuade western powers to bring up genocide and other charges against the Saudi and Pakistani political and religious leaderships, and before embarking on a military offensive.


The 1996 Advisory Opinion of the International Court of Justice even extends such authority to the preemptive use of strategic nuclear weapons in certain existential circumstances.


Should the terrorist attacks continue to devastate India and if Pakistan and Saudi Arabia do not act to discourage jihad, India's existence is threatened and as a nuclear-armed state, it should use every means to devastate Saudi Arabia and Pakistan, paving the way for unraveling of political Islamic movements in India and beyond.


The conundrum of Pakistan is understandable; any limited offensive military measure directed at punishing it will most likely destabilize it and persuade Pakistani military leadership to retaliate with nuclear strikes. However, under the current western policy of "engaging" Pakistan, Al-Qaeda and the Taliban have only grown stronger due to internal support.


India could be the missing link in neutralizing the threat Pakistan poses in Afghanistan and through its procession of "Islamic" nuclear bombs.


If Indians feel that they have to hit back at Pakistan due to extensive internal terror attacks attributable as genocide or crimes against humanity, an option worth backing by the western powers is a full-scale Indian offensive that may involve massive pre-emptive strategic nuclear strikes to first soften up Pakistan, followed by over running Pakistan's territory with Indian troops and liberate its population to Hindu way of life (which culturally Pakistanis belong to), by comprehensively neutralizing its Islamic roots. The West can follow it up by aiding nation-building to be utilized wisely for the first time in Pakistan (until now, the well-meaning western aid has gone into jihad-building there, much to the discomfort of the givers). Such a Pakistan will not only have a negative memory of its Islamic past, but importantly, will be a much less likely terror sponsor.


FP: What can the western powers do?


Muthuswamy: Let me set this section up by first explaining how policy decisions regarding Islamic terrorism are taken in India at the present time.


India's top two leaders' (the unelected Prime Minister Manmohan Singh and his boss, Sonia Gandhi, the president of Congress Party) interaction with the public or journalists on foreign policy and security matters come down to reading statements prepared by aides, with virtually no cross-examination. Singh's long career in the government had been that of an economic technocrat and Gandhi's prior experience consisted of home-making.


Due to these leaders' inexperience on strategic issues, including matters related to Islam or Muslims, Muslim leaders who serve as aides or those who serve in the Cabinet have take the lead in formulating policies. This has been a recipe for disaster as the Muslim leadership in India reflects the Bin Laden loving, fundamentalist-oriented Muslim community.


Not surprisingly, every long-term decision taken by these two leaders have gone on to advance the cause of jihad. Even in cases of obvious Islamist violence, Muslim leaders close to these top Indian leaders have used their influence and access to stymie the investigation and let the terrorists run free. In addition, the Muslim leaders have helped to misguide the focus of government effort away from the roots of terror within their community.


That the Muslim leaders with jihadist outlook are pulling strings behind the top two Indian leaders can explain the bizarre Muslim exclusive promises made by these Indian leaders. Prime Minister Singh stated in Dec. 2006: "They [Muslims] must have the first claim on resources." Sonia Gandhi went a step further. She wrote a letter as part of a 2007 election campaign in India's most populous state, specifically pleading to over 15,000 Muslim leaders, including clerics, "I can build a society of your dreams".


The shocking reality of India is that the ruling Manmohan Singh regime is an unwitting proxy of jihadists on policy matters pertaining to Islam and Muslims.


The ruling regime's success in bringing India along to sign the proposed nuclear deal with America shouldn't misconstrued as an ability to tackle Islamic terrorism. Reason: This proposed deal is not an Islam related issue and hence Muslim "advisors" didn't play a determining role. In any case, in my view, the nuclear deal with India is highly irrelevant for the reason that India will neither be able to securely build nor maintain the nuclear reactors it proposes to construct in another ten years time, should internal destabilizing continue at this rate.


Give these realities it is hard to believe that India is any longer capable of surviving the Islamic onslaught all by itself.


It all comes down to western leaders deciding whether they would like to see India rapidly destabilized by an Islamic war of thousand cuts, with millions of people dying of hunger and malnutrition, and importantly, hostile jihad-sponsoring Muslim states born inside of what is left of India within the next few decades.


When large-scale terrorism that can categorized as crimes-against-humanity is taking place in a nation at the behest of external Islamic powers and where the regime in power is not only ineffective in stopping terror but even seems to act as a proxy for the Islamists, there is every reason for the world powers to step in and help the beleaguered people staring the face of a mutual existential threat.


Such a help can come in the form of backing the nationalist Bharatiya Janata Party (BJP) and its strong leader, Narendra Modi, the chief minister of the Indian state of Gujarat. Indian intelligence has identified BJP as the only main stream party free of terrorist infiltration. Manmohan Singh's Congress Party with its traditional reliance on Muslims has become susceptible to jihadist infiltration and influence.


As part of discrediting the jihadist moral "high ground", the United States must question the credibility of the Kashmir jihad.


The western powers should persuade and back India to build up the case of crimes against humanity implicating both Pakistan and Saudi Arabia through the International Criminal Court. Not just in the case of India, this angle needs to be pursued to include other jihad victim states and also potentially more sponsors, including the Islamic Republic of Iran (due to its sponsorship of terror directed at Israel).


The 1993 World Trade Center bombing and other attacks directed at the United States by Al-Qaeda should have given more than ample warning to the Saudi ruling class (and Pakistan) that continued funding – directly or through government-linked charities – of either the Taliban or Al-Qaeda is to harm American interests – and that corrective measures must be put in place to roll back extremism. We now know that the Saudis and Pakistanis hardly undertook any measures to stop the funding of terrorist groups, let alone undertake any corrective measure, until a least 2001 – and that make these nations significantly responsible for 9/11 attacks on America. Still, the 9/11 Commission has blundered into letting the Saudis (and to a lesser extent Pakistanis) off the hook.


The need to move beyond proxies, from Al-Qaeda, Taliban or Hezbollah to their major sponsors – namely, Saudi Arabia, Pakistan, and Iran – can't be overstated.


Associating Saudi Arabia with genocide and other crimes against humanity gives us an unprecedented ability to regulate its funding for "religious causes" in the West, to even retroactively shutdown any "religious" institution built with its funding, to discredit its standing (Saudi Arabia is synonymous with Islam and vice versa) in the community of societies and nations – and to even seize its oil-based assets (used to sponsor genocide) as a last resort.


Specifically, western powers, going beyond their support for India, should call on the Saudi leadership to allocate, say, 30-40% of its oil-based revenues for rehabilitating Muslims it has indoctrinated all these decades and to compensate non-Muslim victims and their states.


The victim list includes the United States.


Should the Saudis balk at this humanitarian proposal, the western powers should work to add top Saudi political and religious leaderships to the elite list now occupied by the fellow Muslim, Sudan's leader, Omar al-Bashir – now charged by the International Criminal Court. Similar approach may be pursued in the case of Pakistan in order to make it disengage from terror sponsorship directed at Afghanistan and India.


Due to deeply entrenched and popular nature of political Islamic movements based in Saudi Arabia or Pakistan that are answerable to none, it is unlikely that even the above approach will yield any meaningful results. Still, this intermediate step may be necessary before justifying far more lethal means.

Varanasi blasts: 10-yr term for mastermind

LUCKNOW: A Fast Track Court (FTC) in Lucknow on Tuesday sentenced Waliullah, hardline cleric and a key operative of terrorist outfit HuJI, to 10 years in jail, marking a partial success for the law-enforcement authorities who are seeking his proseuction also for plotting the Varanasi blasts.

Waliullah, Imam of a village mosque near Phoolpur town in Allahabad district of Uttar Pradesh, whom the police has identified as the mastermind of the twin terror attacks on Varanasi in 2006, has also been fined Rs 1 lakh.

However, the court which held the Imam guilty of acquiring arms and explosives like RDX for engaging in terrorism and subversive activities, acquitted him of the charge of sedition saying that the prosecution had failed to provide sufficient evidence on that count.

While this appeared to take away a lot from the success of the UP police in securing the sentence, the prosecution refused to treat the mixed verdict as a setback.

It maintained that it, as part of a conscious strategy, had not pressed for Varanasi blasts and sedition case since the matter was being tried as part of another case before a Ghaziabad court.
