Showing no sympathy to an Iranian seeking refuge in India, the Bombay High Court turned down his bail plea on Monday. Mohammed Ali Raihanny, who had changed his name to Krishna Raihany after converting to Hinduism in India, wanted to become an Indian citizen. He had moved HC seeking a conditional release on bail to complete documentation for asylum in India.
On two occasions earlier, the court had rejected his application for Indian citizenship as investigation reports of the central agency pointed to his involvement in hawala transactions and visits to Hindu places of worship.
When asked to report his whereabouts to authorities, he had allegedly changed addresses without informing them. "He has six different addresses," said additional public prosecutor Aruna Kamat-Pai. His trips to Pakistan via Iran also brought his intentions under scanner.
Raihany had filed an application for bail stating that he needed to furnish documents to the United Nations Commissioner for Refugees, which he kept at his residence.
Since religious conversion is barred by Iranian law, Raihany also pled that he feared capital punishment awaited him if he was sent back to Iran, as he had converted to Hinduism.

KARACHI: A pamphlet from a man threatening to blow up Rainbow Centre unless it shut down by September 27 was distributed Saturday night, sparking panic in the ground-floor business owners and people who live in the flats above.
“If the video business does not shut down in two months, there will be an explosion so big that the entire world will remember it,” said the A4 size open letter, written in crude Urdu handwriting and signed by ‘Fatah’. “Even if I do not remain, the voice of Islamic Shariat will never die.”
The open letter also issued a warning to the city’s cinemas, cable operators and public bus drivers who play loud music. “All of Karachi’s cinema hall owners are requested to shut down otherwise after July 27 any one of them could be blown up with a bomb at any time,” the letter said.
“Cable operators should only air Islamic channels and if any vulgar programmes are broadcast in any locality of Karachi, the cable operator’s office will be blown up,” it added.
The letter’s writer said that vulgarity and obscenity had become exceedingly common and that the various forms of the media were showing dancing and singing. He appealed to people to shun these forms of entertainment and for those he threatened to desist from their work.
The pamphlet was reportedly distributed to all the shops on the ground floor of Rainbow Centre by two children, aged seven and nine, said Waqas Khalid who works at shop No. G-39 and Nadim of shop No. G-112. The children did not know what was written in the letter, added Waqas of shop No. G-111. As the salesmen read it and the news spread, shopkeepers grabbed the children and questioned them.
The children, who are from the neighbourhood, said that they were given Rs 100 each by a tall man with a big beard. He was wearing a shalwar kameez and skull cap. He gave them the pamphlets and told them to just throw it into each shop.
The Rainbow Centre union got together to discuss the problem and when this report was filed they were drafting a letter to the law enforcement agencies that they planned to dispatch Monday (today).
Acting chief of police Javaid Bukhari told Daily Times Sunday night that he had not received any complaint but if he did the police would obviously do everything in their power to prevent anything bad from happening. “We can give solve the problem 10 percent by giving them extra security but 90 percent of it will depend on their own vigilance,” Bukhari said, adding that he was going to look into the matter today.
Rainbow Centre union president Salim Memon said that while he agreed that there should be an Islamic system, threatening people with bombs was no way to impose it. One of his colleagues, Muslim, added that some people thought that distributing a letter like this was a “short cut” to heaven. Rainbow Centre will tighten security but are also deciding whether to continue work as usual or shut up shop.
The chairman of Media Plus Communications Amir who is also part of the management of Nishat Cinema said that they had not received the pamphlet.
JUI-S’s Mufti Muhammad Usman Yar Khan urged would-be suicide bombers and note writers to stay away from unlawful activities and use the Islamic way of Da’wah (Tableegh), instead. Religion does not condone suicide bombings, said JI’s Merajul Huda Siddiqui. “Rulers should also realise, however, that the undue use of power gives rise to another kind of powerful movement. Our rulers think that steam would be released if they have a photo session at the Ka’ba.”

Four men who had sex with a twelve year old girl after breaking into her home in January have been cleared of rape. A judge found the girl from Kurendhoo, Lhaviyani atoll, had consented to have sex with the men after they smashed her bedroom window with an axe.
The judge sentenced the four men to eight months exile from Kurendhoo for sex outside marriage. The sentence apparently contradicts a government commitment in May that child sex offenders would be imprisoned rather than banished.
On January 31 the men aged between nineteen and twenty-five used an axe to smash the window of the girl’s bedroom before taking her from her bed and having sex with her. The state charged the four men with rape.
But in his summation the judge noted “the girl had reached puberty” and found “she was a willing partner,” because she had not screamed, struggled or told her sister-in-law or step mother about the event.
He found the men guilty of consensual sex before marriage, and imposed the minimum sentence of eight months banishment. The standard sentence for sex outside marriage, even for couples who have consensual sex while engaged to be married, is twelve months banishment.
The Attorney General has promised to appeal against the case, but women’s rights activists are furious at the decision. “I am amazed the judge has presumed a twelve year old girl can give consent to four men to have sex with her,” said Aishath Velezinee, of women’s rights NGO Hama Jamiya [Justice Organisation]. “This is obviously a case of gang rape.”
Velezinee is furious “four men, who raped a twelve year old, will be sent to an island, possibly four separate islands, where there will be other vulnerable young females.”
She says the Deputy Home Minister Azima Shukoor had promised a UN conference in Geneva in May, child sex offenders would be imprisoned rather than banished.
Aminath Eenas of the Gender Ministry also revealed her ministry has told the legal authorities sex offenders should be “imprisoned not banished,” and evidence of abuse victims be “heard in private not open courts.”
“We have asked repeatedly, but there is nothing else we can do,” Eenas complained.
Justice Minister Mohamed Jameel said there is “a judicial practice to sentence such offenders to imprisonment,” and did not know why the judge “departed from the prevailing practice.”
But of Azima Shukoor's promise to the UN, Velezine said, “the minister completely distorted the truth. The law clearly still permits banishment for child sexual offences, and the judiciary does not consider this a serious crime.” On Wednesday Azima told Minivan News she was “too busy to discuss this.”
“The sentences send completely the wrong message. It tells men of all ages they can get away with rape, and it tells young women not to come forward as they will be re-victimised by the judicial system,” Velezinee went on.
And she called on the Gender Ministry to “condemn the decision in the strongest possible terms,” and “make sure this goes all the way to the high court.” The Gender Minister, Aishath Didi, has so far refused to comment on the case.
