NEW DELHI: The Malaysian government has no immediate plans to review the detention of five Indian-origin leaders, who were arrested under a
controversial law for organising an unprecedented public protest against alleged marginalisation of the ethnic Indian community.

Malaysia has kept in detention the Hindu Rights Action Force (Hindraf) leaders since last one year under the Internal Security Act (ISA), which allows authorities to hold people for indefinite period without trial.

Malaysia's human resource development minister S Subramanian said the release of the Hindraf leaders will depend on the recommendation of a review board which meets once in six months.

"We have a system of reviewing the (release of) those who were arrested under the act. This is done on a periodic basis on every six months," the visiting minister said when asked about release of the detained leaders.

The review board met few months back and decided against releasing the leaders. Its next meeting is expected to take place after couple of months.

Subramanian said the board comprising neutral members meets once in six months and if it suggests releasing them, then the government will set free the detainees.

"When their findings suggest that timing is appropriate for such release to be made, then they will be released," he said without specifying timing of their release.

Hindraf, which has been spearheading agitation demanding more rights for ethnic-Indians, came into international focus after it organised an unprecedented public protest in November 2007 against alleged marginalisation of the community.

KUALA LUMPUR, Malaysia (AP) — An influential council of Malaysia's state rulers has warned people not to question the supremacy of Islam or the special privileges enjoyed by the country's ethnic Malay majority.

Racial and religious tensions have increased in the past year as minorities have become more vocal in their complaints about an affirmative action program that they say unfairly favors Malays. They also complain that their religious rights are being ignored.

In an unprecedented comment on current affairs, the sultans of nine states did not directly accuse the Chinese and Indian minorities of stoking anti-Malay feelings, but said recent statements and forums "held by certain quarters" had "caused provocation and uneasiness among the people."

Questioning the special position of Malays "can lead to disunity and racial strife that can undermine the peace and harmony," the state rulers said in a statement.

The warning underscores the social tensions in Malaysia, where Muslim Malays are about 60 percent of the nation's 27 million people. Chinese and Indians, who are mostly non-Muslims, comprise a third of the population and friction among the three ethnic groups is always below the surface.

The lengthy statement issued Thursday night follows a two-day meeting of the sultans, known as the Conference of Rulers. The hereditary sultans, who are Muslim Malays, occupy ceremonial offices but wield considerable moral authority among Malays.

"It (the warning) is quite unprecedented and I think it is coming in response to what the country is facing — what the rulers perceive as the fracturing of racial harmony," said Tricia Yeoh of Center for Policy Research think-tank.

Last month, an ethnic Chinese opposition lawmaker was accused by a Malay newspaper of being anti-Islam. She was detained by police for a few days but no charges were filed. In August, lawyers were forced to abandon a conference on religious conversion after protesters stormed the forum.

The statement reiterates the supremacy of Islam, the special position of the Malays and the guarantee to protect minority rights — all enshrined in Malaysia's constitution.

"Non-Malays should not harbour any apprehension or worry over their genuine rights because these rights are guaranteed," the statement said.

Demolished Hindu temple to be rebuilt on new site
SHAH ALAM: A new site for the Sri Maha Mariamman Temple in Kampung Rimba Jaya, Padang Jawa, which was demolished in November last year has been approved.

Mayor Mazalan Md Noor said the temple would be rebuilt soon on a 10,000sq feet land near the Keretapi Tanah Melayu quarters, a much bigger site than the original temple.

He was speaking to reporters after Mentri Besar Tan Sri Khalid Ibrahim, PKR de facto leader Datuk Seri Anwar Ibrahim and Shah Alam MP Khalid Abd Samad visited the Rimba Jaya flats Monday.

The Hindu temple was ordered torn down by the authorities as it stood in the vicinity of the Rimba Jaya squatter settlement.

The 11ha site in the area is owned by Ken Rimba Jaya Sdn Bhd.

“The developer has been directed by the state government to provide the land and RM40,000, the cost of the building construction.

“It is up to the temple committee and the developer to decide when to start the temple construction,” he said.

Mazalan said the Shah Alam City Council had cleared up the land to make way for the temple project.

Earlier, Khalid and Anwar had a dialogue with the Kampung Rimba Jaya residents and the demolition of the temple was among the hottest issues raised during the 15-minute meeting.

Khalid said the new state government was working hard to solve the squatter problems in the state.

KUALA LUMPUR, Malaysia (AP) - A Muslim-born woman arrested for joining a banned sect was sentenced to two years in jail for renouncing her religion, her lawyer said Tuesday.
The case underscores growing concern about religious freedom in this mostly Muslim nation, where Islamic Shariah courts _ which govern the personal conduct and religious lives
of Muslims _ have invariably refused to sanction the conversion of people who try to leave Islam.
A Shariah High Court judge in eastern Terengganu state ruled Monday that Kamariah Ali is still a Muslim despite her declaration to the contrary.
«The court is not convinced that the accused has repented and is willing to abandon any teachings contrary to Islam,» news reports quoted Judge Muhammad Abdullah as saying. «I pray God will open the doors of your heart, Kamariah.
Court officials could not be reached for comment Tuesday, a state holiday.
Last month, Kamariah, 57, was convicted of declaring herself an apostate after she and 58 others were arrested in July 2005 for following the teachings of the banned Sky Kingdom, a local sect claiming to promote interfaith harmony.
Kamariah's lawyer, Sa'adiah Din, said her client, who started serving her sentence Tuesday, insists she is no longer a Muslim and has instructed her to appeal the conviction and verdict.
«She informed the court that she is not a Muslim,» Sa'adiah told The Associated Press. «She doesn't come under Shariah court anymore.
Kamariah has already been convicted of apostasy in a separate case in 1992, and served less than 20 months, Sa'adiah said.

«This has to stop. They can't be sending her again and again to prison for this,» Sa'adiah said, adding she had little hope in Kamariah's appeal.
Sa'adiah said Kamariah also is facing a second charge of joining a banned sect, which is punishable by up to two years in prison. Hearings are scheduled to begin in May with most of the other alleged sect members arrested in 2005.
Kamariah's case highlights a dilemma faced by those who want to leave Islam in Malaysia, where Muslims make up 60 percent of the population. In the past, Muslims who renounce Islam have been sent to religious re-education camps.
Kamariah filed an application in civil court in 1998 to declare herself an apostate, but a Federal Court ruled in 2004 that it had no jurisdiction in the case and sent Kamariah to Shariah court, which administers civil matters for Muslims, Sa'adiah said.

KUALA TERENGGANU: A former religious teacher was yesterday found guilty of having proclaimed herself an apostate to avoid action being taken against her under syariah.

In finding 57-year-old Kamariah Ali guilty, the Syariah High Court here ruled that she was still a Muslim.

This was because her earlier application at the Syariah High Court in Kelantan to leave the religion had been rejected.

Kamariah is a follower of Kamal Ariffin a.k.a Ayah Pin, whose teachings were considered to be deviant.

In passing judgment, judge Mohamad Abdullah said based on fiq (Islamic practices), a person is a Muslim until proven that he or she had left the religion but in Kamariah's case, there was no solid evidence to cast doubts on the prosecution's case.

Kamariah was charged under Section 7 of the Syariah Criminal Offence Enactment (Takzir) (Terengganu 2001) with declaring herself an apostate to avoid action being taken against her at the Syariah lower court in Besut.

She had been arrested together with 58 other followers of the Ayah Pin sect on July 21, 2005.

They were all charged under Section 10 of the Syariah Criminal Offence Enactment (Takzir) (Terengganu 2001) with not adhering to the state fatwa which had ruled Ayah Pin's teachings as deviant.

Mohamad said although Kamariah claimed she had left the religion in 1998, she was still teaching at an Islamic institution in 2000.

Furthermore, her declaration of leaving Islam was done in front of a commissioner of oaths instead of at the Syariah court.

Mohamad said he did not want to punish her as he would rather see her return to Islam.

"I want to give you a chance and hope you will have a change of heart and the sentence will then be based on the progress that you have made. I have seen some changes, but I still have some doubts."

Prosecutor Mustafar Hamzah, however, pressed for a deterrent sentence in view of the seriousness of the offence which could affect public order and the faith of Malaysian Muslims.

He said the defence could not argue that Kamariah had been influenced by others when declaring herself an apostate.

Mustafar said as an Al-Azhar University graduate, she was knowledgeable in religious matters and should not have committed such an act, adding that Kamariah had not shown any sign of remorse or repentance.

Later, after a stand down for about 30 minutes, Mohamad allowed Kamariah, who was represented by Sa'adiah Din, to plead for leniency.

At this point, Kamariah said she wished to repent.

Mohamad advised her that apart from repenting, she should never again follow the teachings of Ayah Pin or that of other deviant groups.

"I hope you not only realise your mistake but promise never to repeat it. Although, as you said earlier, your faith is between you and God, this particular case affects society. It is up to you to prove your sincerity."

Earlier, Kamariah had put up a defiant front, arguing with the judge on the concept of freedom of religion. She had also refused to utter the syahadah (proclamation of faith).

Muhamad fixed March 3 for sentencing.

POLITICS-MALAYSIA: Rising Hindu Activism May Upset Poll Calculations

KUALA LUMPUR, Feb 4 (IPS) - A new political force -- right wing Hindu activism -- has emerged in multi-ethnic Malaysia adding, in an election year, volatility to the country's already religiously charged politics dominated by the majority Malay Muslims.

Across the country, Indian Tamils are mobilising to protest against alleged socio-economic neglect, under the banner of Hinduism in an awakening that is vocal but disorganised providing an open field for opposition political parties to exploit.

Ethnic Indians, who make up about eight percent of the population of 26 million people, complain that majority Malays have used their political power and special privileges to corner for themselves opportunities in employment, education and business.

The Chinese, who first arrived as labourers to work in the tin mines, now form 25 percent of the population and are economically the most vibrant group -- controlling some 60 percent of the economy.

On Nov. 25, ethnic Indians took to the streets en masse to protest against alleged discrimination that resulted in the indefinite detention of five top leaders of the Hindu Rights Action Force (Hindraf).

Malaysian Prime Minister Abdullah Badawi has acknowledged that the grievances of the Indians, as highlighted by the Hindraf, may dent election prospects for the ruling National Front. ‘’Yes, I think votes will be affected somewhat,’’ he was quoted as saying by the Sunday Star newspaper.

Much of the new ferment is visible in the hundreds of Hindu temples where working class Tamils, mostly youths and young married couples, gather to avoid police harassment and speak out against pro-Malay policies that they say has sidelined them.

"We have been left out of 20 years of progress and development," said Munusamy Marimuthu, 28, a supervisor in a small rubber factory, his two-year-old daughter, Savitri, in tow.

On the weekend, Marimuthu joined some 800 working class Tamils to pray to Lord Muruga, the sentinel god of the Tamils, at a Hindu temple in Kuala Selangor, a town set amidst oil palm plantations about 70 km east of the capital. They also broke coconuts, a religious act usually associated with seeking divine intervention to resolve woes faced by devotees.

"I am proud to be a Hindu," Marimuthu, a descendent of 19th century Tamil indentured labourers from South India, told IPS. "I feel protected."

"Our politicians have betrayed us… only our energy and our god can protect us now," he said echoing the views of the majority of Tamils in the country caught up in a ‘Makkal Shakthi’ (people power) movement.

The youths were led in their protest prayers by a saffron clad priest from South India chanting in Sanskrit, the ancient language of Hinduism, which few of the congregation could understood but nevertheless the camaraderie was high.

"For the first time we are united and under the banner of our religion," said another protestor Arumugam Chedi, 39, a laborer. "Our religion is under threat but now we are united and can show our anger."

At every such function the protestors also release five pigeons in honour of the five incarcerated leaders of the Hindraf. The five are being held without trial at a political detention camp in Northern Perak state, accused of "developing links" with Sri Lanka’s militant Liberation Tigers of Tamil Eelam (LTTE). They have denied the charge.

At the center of the Makkal Sakthi protest are allegations that Badawi has failed to take firm action to "right the wrongs" faced by the Tamils and for the harsh action meted out to the Hindraf leaders in spite of the political support given to the ruling National Front.

Abdullah is blamed for standing by Samy Vellu, longtime president of the Malaysian Indian Congress (MIC) which is a partner in Abdullah's National Front coalition government.

"Indian anger is focused on Samy Vellu who is seen as betraying the community by not speaking up for its needs in the government," said parliamentary opposition leader Lim Kit Siang. "He should resign because Indians have rejected his inept leadership," Lim told IPS.

Lim, who leads the Democratic Action Party (DAP), has demanded that two of the detained Hindraf leaders, M. Manoharan and B. Ganabathi Rao, be allowed to contest the elections, widely expected in March. Both men happen to be DAP members.

On Jan. 23 Hindus showed their anger and frustration at Samy Vellu and the MIC by boycotting the Thaipusam festival, the biggest event on the calendar for Malaysian Hindus, that is held annually at the Batu Caves temple complex outside the capital.

Typically about 1.5 million devotees and spectators, on average, throng the caves for the festival. But this year only about 300,000 Hindus showed up with most people staying away in support of the boycott and reject Samy Vellu, who traditionally opens the celebration with an early morning speech.

SMS text messages were extensively used by Indian groups that back the Hindraf to persuade Hindus to stay away.

With Abdullah's popularity among Indians plunging and Samy Vellu's leadership discredited Indian voter support for the government is at an all time low.

"We expect the majority of Indians to vote for the opposition this time," said Murugesan Kulasegaran, the only ethnic Tamil opposition lawmaker in parliament. "They can be kingmakers in at least 30 parliamentary constituencies…Their voice will be heard this time," he said.

The opposition Chinese-majority Democratic Action Party and opposition icon Anwar Ibrahim's National Justice Party are potentially the big gainers from the Indian minority votes.

However the rise of Hinduism is also unleashing other potentially divisive forces that pose a potential danger to this fragile multi-ethnic society.

As a counter reaction Malay Muslim support is rising for Badawi, opinion polls show. From about 65 percent a year ago support is now nearing 80 percent and rising.

Another significant sign is that while Tamils are flocking to opposition party rallies, Malay Muslims and Chinese, who form 30 percent of the electorate of 13 million, are conspicuously missing.

Observers say the business-minded Chinese who cherish stability and a strong central government are feeling uneasy with the rise of Hinduism as a political force. "They fear how Muslims would react and the possible implication for stability and growth," a senior University of Malaya lecturer told IPS. "They worry because the multi-ethnic society is already under stress.'

The rise of Hinduism will have an impact on the voting trend among Malay Muslims, who form 60 percent of the voters, the lecturer said, asking not to be named. ‘’They are more likely to side with the government seeing it as better able to 'protect' Islam against a ‘Hindu upsurge’.’’

The net effect, many fear, is that the opposition political parties might end up winning "large chunks" of the smaller Indian vote but lose "large chunks" of the bigger Malay and Chinese votes.

Hindu woman fights for dead Muslim son’s insurance

KUALA LUMPUR, January 30: A Hindu woman has spurned an offer by Malaysia’s Islamic authorities to settle a dispute over her dead Muslim son’s insurance policy in a case that highlights growing conflicts over religious rights, a lawyer said on Wednesday.

The Federal Territory Islamic Council offered on Tuesday to give Rukumony Muthiah two-thirds of the 56,300 ringgit ($17,400) death insurance of her son, a Muslim convert who died in 2000, Rukumony’s lawyer Darshan Singh Khaira said.

In his insurance policy, Rukumony's son, Ragu Ellaiappan, whose Muslim name was Mohamed Redzuan Abdullah, named Rukumony as his beneficiary, Darshan said. But Islamic authorities have argued in court that under the country’s religious laws for Muslims, a non-Muslim cannot claim inheritance from a Muslim, he said.

“Our federal constitution guarantees equality so how can you say a non-Muslim cannot inherit from a Muslim, but a Muslim can inherit from a non-Muslim?” Darshan said. Islamic council officials familiar with the case could not be reached.

The council’s lawyers made the offer in the High Court in northern Penang state on Tuesday, but Darshan said it was a “fairy tale offer” that was unacceptable.

Rukumony, a 61-year-old ethnic Indian widow, is willing to settle for 80 per cent of the total sum, Darshan said. The court scheduled to hear the case March 14.

His death certificate says he died of a brain infection at the age of 23, but the family believes there could be more suspicious causes linked to his stint as an army ranger because they have not been shown the post-mortem results, he said.

Malaysia’s non-Muslim minorities say a spate of court cases in recent years, involving disputes between Muslims and non-Muslims, have usually ended with the Muslim side winning.

Abused, raped, unpaid - in Malaysia

KUALA LUMPUR: Countless millions of Asian women leave their homes to work in foreign countries, and in a quiet dormitory behind the Indonesian embassy here are some of the casualties of this mass migration. Some of them have been beaten, raped or tortured with scalding water and hot irons, and nearly all have been treated like slaves and not paid for months or years of exhausting work. Now they wait for their cases to be resolved via mediation with resentful former employers, or make their way painfully sl
owly through Malaysia's court system, before they can return to their villages and towns. Malaysia is a relatively prosperous nation whose citizens have come to rely on foreigners to care for their children, clean their homes, and work on the plantations. But every year about 1,000 women come to the barracks-style accommodation built behind the embassy on a main thoroughfare in Kuala Lumpur, along with about 20 newborn babies-often the product of sexual assault.

I would tell other girls not to come here-just look at what happened to me," says Suryani Enas, eight months pregnant after allegedly being raped by a member of a feared volunteer security corps accused of persecuting migrants in Malaysia. In a common tale, Suryani explains she ran away from employers who refused to pay her for three years of work, only to find herself in the clutches of the officer who held her captive for a month-handcuffed and gagged. The case is now before the courts, but it could tak
e years to resolve and the 20-year-old is anxious to return to her home in the Indonesian island of Lombok and raise her child the best she can. "I was forced to be pregnant, and now I'm forced to love the child," she says simply as she holds her swollen belly, smiling bravely despite her ordeal. The rights group Tenaganita-its name means "Womanpower" in Malay-says Malaysia is home to some 300,000 foreign domestic workers among a migrant workforce-both legal and undocumented-of more than three million.

It argues that foreign domestic workers here are made highly vulnerable by a lack of legal protection which subjects them to any working conditions an employer sees fit. "We can safely say we are one of the worst states, the country that least protects foreign workers including domestic workers," says Tenaganita migrant worker advocate Florida Sandasamy. "Domestic workers do not have days off, they can work 24 hours a day-there are no rules," she says. "There is absolutely no protection for them, because t
he employment act only goes as far as paying workers their wages." In contrast, women from the Philippines, whose government insists on contracts enshrining regular days off and payment, are rarely victims of abuse and earn up to four times the 120 dollar monthly wage of many Indonesians. "Sad to say, Indonesia and the other countries do not share the same policies," Sandasamy says.

Up to 100 women live at any one time at the Indonesian embassy's shelter, a simple but scrupulously clean structure built in 2004 that is one of several around Asia and the Middle East. Some stay for a few days, some for years. The women occupy themselves with washing, cleaning and cooking, but mostly sit around quietly, often exchanging their stories of mistreatment at the hands of Malaysian employers. Many still bear the scars, scalds and wounds inflicted on them as recently as days before. Most are dest
ined to remain anonymous, but the case of one of them, Nirmala Bonat, has achieved national notoriety. Photographs of her dreadful injuries, allegedly inflicted by the Malaysian woman she worked for at an upmarket Kuala Lumpur condo, were splashed on the front pages of newspapers when she was discovered in 2004.

The 23-year-old says that after accidentally breaking a mug, she was abused every day until her breasts and back were covered with burns from a hot iron, and her face was swollen by regular beatings. The alleged culprit has been brought to trial, but three years have gone by and it is nowhere near a conclusion. "I'm hoping that the whole case is resolved as quickly as possible so I can return to Indonesia," Nirmala says in a voice barely above a whisper. "I really regret coming here. This was my fate. Som
e people are lucky and get good jobs, but I was very unlucky," she says before breaking down in tears. Sandasamy says the protracted legal process is extremely damaging for women like Nirmala, who inevitably sink into depression as they are forced to put their lives on hold and endlessly relive the trauma. "Very few cases go to court and the ones that do take a very long time. So where is the state's responsibility? If the employer is not taken to task, they become arrogant and feel they can do anythng the
y want," she says.

Indonesian diplomat Tatang Razak, who heads the embassy's anti-abuse task force, says he can barely believe the treatment meted out to women who end up at the shelter, who also include many victims of sex trafficking. Newspaper reports detail accounts of women allowed just one bowl of rice a day, allowed only a few hours sleep on the kitchen floor and made to wash dog kennels despite their Muslim beliefs. Tatang says the situation has improved in recent years as Indonesia has demanded better treatment for
its workers, but there are still tensions with the government uneasy about having so many here. "Previous they welcomed Indonesians to Malaysia-until 1970 it was very easy to become a Malaysian citizen," Tatang says. "Now that has all changed. They consider there are too many Indonesians. Their economy is advanced and they think they don't need the workers." - AFP

'I appeal to all human rightists to help Malaysian minorities'

The man who shook the Malaysian government is currently in India trying to garner support for the agitating Hindus of Indian origin under the banner of the Hindu Rights Action Force. P Wytha Moorthy, HINDRAF's president, met Tamil Nadu Chief Minister M Karunanidhi in Chennai, the Bharatiya Janata Party's prime ministerial candidate L K Advani in New Delhi and leaders of various other parties, capping it with a speech at the Indian Law Institute.
An unassuming and simple person, his eyes show anger and sadness when he speaks about how Malaysian citizens of Indian origin, mostly Hindus, have been treated in Muslim-dominated Malaysia, and recounts the incidents: temples trashed, married women forced to get Islamised, Hindus buried as Muslims, and doors closed for employment and business opportunities.

Malaysia has been a region with a marked Hindu influence since the second century Gangga-Negara era to the Sri Vijay Empire ending in the 14th century. The Islamic influence grew through traders and battles in the 15th century, yet the Hindu marks show up everywhere. 'Malay' in the country's name and 'Pur' in its capital Kuala Lumpur are Sanskrit words, and its national language is Malay Bahasa (or bhasha), sons of the soil are called Bhumiputras.

Yet, the growth of Arab money and the Wahabbi influence has resulted in the denial of the country's heritage and a discriminatory policy towards non-Muslim minorities, as evidenced by the recent protests in the country. Wyatha Moorthy spoke to Tarun Vijay in New Delhi about the conditions in Malaysia.

What brings you here when Malaysian Hindus of Indian origin are agitating back home?

I am here to request Indian leaders and the media, who have always supported human rights of persecuted people the world over, to give voice and support to Malaysian citizens of Indian origin reeling under the torturous attitude of an oppressive Malaysian government.

The way our November 26 protest rally was crushed and people praying before the Batu Caves temple were arrested and later attempt to murder charges were registered against them, clearly shows that the government doesn't have any sympathies for the issues we have raised and wants to throttle the voice of reason through brute force.

I am going to the United Kingdom and the United States of America to seek international support.

Why should you seek support from outside Malaysia? Why can't you fight it out on your home turf?

We have been protesting mildly and waiting for justice for the last 50 years in general and 20 years in particular. More than one thousand letters, all recorded, have been written to the prime minister, even the Sultan, and all the political leaders. But nothing happened.

There have been numerous cases which created anger and instilled a feeling of subjugation among Hindus in Malaysia, yet they chose the prescribed way of mild protest. Their women were kept forcibly in Islamic 'rehabilitation' camps and asked to convert

A famous case is Revathi, whose 15-month-old daughter was snatched from her Hindu father and sent to the mother's parents to be raised a Muslim. A Hindu mountaineer was buried as a Muslim against the wishes of his family and without proof that he had converted to Islam.

So far thousands of temples have been razed before weeping and praying Hindus, the latest one being a hundred-year-old Maha Mariamman temple.

When, for the first time in Malaysia's history, Indian origin citizens of Malaysia protested unitedly on November 26, the rally was declared illegal and chemical mixed water cannons were used by police who brutally assaulted women demonstrators too. Thirty-one Hindus have been charged with attempted murder.

I appeal to the human rightists of the world to help the Malaysian minorities. That's the reason I am here.

How are the general economic conditions? A Malaysian minister has stated that Indian origin people are more prosperous than the Bhumiputras?

Statistics speaks the truth. Indians form 60 per cent of urban squatters and 41 per cent of total beggars (The Economist, February 22, 2003). About 70 per cent of our community is in the poor/hardcore poor segment but receives no attention from State powers.

Hopelessness, poverty and lack of opportunities lead to high rates of Indians working as petty labourers, office boys, security guards, public toilet cleaner, road sweepers etc.

Your rally turned violent and the government accused it of damaging public property and attacking the police.

The fact is the rallyists were totally peaceful. This was first time in our history that such a large number of people of Indian origin had gathered, defying efforts by government leaders including the prime minister who said Tamils shouldn't come out of their homes on November 26. Yet, everybody came out, because they wanted to show solidarity against continued oppression.

HINDRAF is a Hindu front of Malaysian citizens of Indian origin. How are the other minorities responding?

The UMNO (United Malays National Organisation)-led Barisan Nasional (the 14-party national coalition government) targets us particularly. Malaysia is a constitutionally declared Islamic republic and only Malay Muslims are recognised as Bhumiputras or sons of the soil. But other minorities and human rights groups in Malaysia are standing with us.

Why are the temples being demolished?

It all got accelerated during (then prime minister) Mahathir Mohammed's regime. They say the temples were built illegally without the government's approval. But they don't recognise the fact that these temples were built before the constitution came into force. They were mostly on plantations, as Indian origin Hindu Tamils were brought there by the British as plantation workers and were allowed to build the temples.

Now, after 50 years or 100 years of such construction, if the government says bring the original land use documents, how can we give that?

The Chinese, Christians, Buddhists and other minorities along with progressive Muslims are also sympathising and actively supporting us to uphold human values. Former deputy prime minister Anwar Ibrahim has issued a statement supporting the cause of ethnic Indians, saying it is purely a matter of violation of human rights and Indian origin people are being denied the right to equal opportunity which has been guaranteed by the constitution.

Generally, the local NGOs and Muslim masses fully appreciate our pain and problems. It is only political expediency that is hurting us. I am sure the government will have to rethink its repressive policies towards us.

Why did you want to petition the British queen, and why did you display Mahatma Gandhi [Images] posters at your rally?

It was the British who brought our ancestors here 150 years earlier. They were not allowed even to write letters or have any communication with their families in India. I am of Tamil origin but can't say which my original village is because the British cut off all our links with India. Now, as a result, we are forlorn and facing the brunt of religious fundamentalism. Hence, it is the responsibility of the British to ensured the protection of the rights and privileges of ethnic Indians. Mahatma Gandhi is a global icon of non-violence, justice and fair deal.

What about the new generation of Malay Hindus?

They are the worst affected. They feel marginalised and permanently colonised. Traditionally Indian doctors are highly respected and well qualified, but now to deprive us of the medical profession the government has reduced medical seats in the University of Malaya for us by 98 per cent, from 16 in 2001 to just one in 2003, so that Indian origin youth (of 1.8 million Indians) have to compete for just one medical seat in this university, which is disproportionate to their numbers.

When they opted to study at affordable universities abroad, the government started derecognising their degrees in an abrupt manner. In the general category also, the university intake for Indians has been reduced drastically -- from 20 per cent in 1956 to 5.2 per cent in 2003.

Studies have shown that Indian origin Malaysians have the lowest per capita income, of about RM 1000 per month, while the national per capita income is projected at RM 17,741 in the 2006 budget.

What was the response you received in India?

Very good. Indian leaders, government officials and the foreign ministry were helpful and sympathised; especially the media, which also took up our cause.

Malaysia charges 26 ethnic Indians

Twenty-six ethnic Indians have been charged with attempted murder in connection with an anti-discrimination rally in Malaysia last month, a lawyer said on Tuesday.

The defendants pleaded innocent to charges of attempting to kill a police officer during a clash at a temple compound outside Kuala Lumpur on Nov 25, said lawyer M Manoharan Malayalam.

The rally, involving 10,000 people, was the largest protest in at least a decade involving Indians, the country's second-largest minority population after ethnic Chinese. They had demanded equality and fair treatment in Muslim-majority Malaysia.

''It's very shocking,'' Manoharan told The Associated Press. ''This is a clear victimisation of the Indians by bringing forth a malicious prosecution that is race-based.''

Attorney General Abdul Gani Patail said the policeman received stitches on his head after being attacked with bricks and iron pipes.

''This has nothing to do with race,'' he told the AP. ''We follow the law. It applies to everyone under the sun.''

Manoharan said the 26 Indians were earlier arrested during the rally and about half of them have already been charged for illegal assembly. They were released on bail but police rearrested them at their homes before dawn today in a surprise raid, he said.

They face up to 20 years in prison if found guilty, he added.

Indians, which make up eight per cent of the country's 27 million people, say they suffer discrimination because of an affirmative action policy that favours the majority Malay Muslims in jobs, education, business and government contracts.

Allegations of marginalisation

The Malaysia-based Hindu Rights Action Force (HRAF) on Tuesday said Prime Minister Manmohan Singh should engage his counterpart in the South East Asian country Abdullah Ahmad Badawi in dialogue to discuss the allegations of ''marginalisation'' of ethnic Indians there.

''Malaysia is economically dependent on India, a fact which India can use to engage them in a dialogue and Singh should talk to his counterpart,'' founder-chairman of HRAF P Wayda Murthy told reporters here.

Referring to the assertions by Malaysian ministers that the agitation launched by ethnic Indians, mainly Tamils, was an internal affair of that country, Murthy, who is camping here for the past few weeks after he was released from detention by Malaysian Police, said there should be international pressure on Kuala Lumpur to respect human rights.

Murthy has already met Tamil Nadu Chief Minister M Karunanidhi and sought his support for their movement.

He said he wanted the countries in the world to ask Malaysia about the ''human rights violations'' as it was a member in the United Nations.

''Malaysia is a member in the UN and therefore answerable to others. We want the international community to ask Malaysia about the human rights violations on the basis of the Universal Declaration of Human Rights 1948,'' he said. (With agency inputs)

இந்திய கம்யூனிஸ்ட் எம்.பி., டி.ராஜா பேசும்போது, `இந்தியாவுக்கும் மலேசியாவுக்கும் இடையே இருக்கும் நல்லுறவைப் பயன்படுத்தி, இந்த தாக்குதல் சம்பவத்திற்கு உடனடி தீர்வு காண வேண்டும். இதுபோன்ற துயரமான சம்பவங்கள் நடைபெறாமல் இருக்க வெளியுறவு அமைச்சகம் துரிதமான நடவடிக்கைகளில் ஈடுபட வேண்டும்' என்றார்.

கைது செய்யப்பட்டவர்களிடம் விசாரணை: மலேசிய அரசு முடிவு: `இந்துராப்' அமைப்பின் தலைவர்களில் ஒருவரான உதய்குமார், பிரிட்டன் பிரதமர் கார்டன் பிரவுனுக்கு ஒரு அறிக்கை அனுப்பியுள்ளார். இந்த அறிக்கை, `வெப்லாக்' என்ற இணைய தள முகவரியில் வெளியிடப்பட்டுள்ளது. இதில், கடுமையான வாசகங்கள் இடம் பெற்றுள்ளதாக மலேசிய அரசு கருதுகிறது. இந்த அறிக்கையின் நம்பிக்கை தன்மை குறித்து ஆய்வு செய்யவும் மலேசிய அமைச்சரவை முடிவு செய்துள்ளது. போராட்டத்தில் ஈடுபட்டு கைது செய்யப்பட்டுள்ளவர்கள் போலீஸ் விசாரணைக்கு உட்படுத்தப்படுவர் என்றும் கூறப்பட்டுள்ளது.

At least 80 ethnic Indians have been charged with illegal assembly in Malaysia, after a weekend of protests in the capital, Kuala Lumpur.
Activists appeared in several courts around the country to deny the charges, and many were freed on bail.

Thousands of Hindu activists took to the streets to protest at what they regard as decades of discrimination by the mainly Malay-Muslim government.

One of the rally's organisers vowed to continue fighting for Indian rights.

"People won't be deterred. They want to put their foot down," said P Uthayakumar.

"To me it is racially motivated. The public will have more hatred for the government."

Thiruchelven Rajoo, a 30-year-old electrician who was charged with illegal assembly, told the Associated Press he did not regret taking part in the rally.

"I am not worried because I am doing it for my rights. It is unfair to all Indians in Malaysia ... they treat us like dogs."

Compensation claim

Meanwhile, government lawyers are seeking to overturn a decision by the courts to free three of the protest's organisers, who were held on charges of sedition, state news agency Bernama reports.

Judges freed the men after prosecutors failed to provide a translation of their allegedly seditious comments, which had been made in Tamil.

The legal moves against the activists came the day after Malaysia's Prime Minister Abdullah Badawi raised the possibility of using strict security laws to clamp down on protesters.

Mr Abdullah said the Internal Security Act, which allows indefinite detention without trial, could be used.

The stated aim of Sunday's rally was to call on the British government to pay compensation to the descendants of ethnic Indians taken to Malaysia as indentured labourers in the 19th Century.

But the real goal of the demonstrators was to highlight perceived discrimination against ethnic Indians.

Activists say policies granting jobs and economic advantages to the ethnic Malay Muslim majority leave many Hindus in poverty.

Majority ethnic Malays are mostly Muslim
Three Hindu activists in Malaysia have been charged with sedition over plans to stage a rally in the capital to air the grievances of ethnic Indians.
They are seeking reparations from the UK for bringing Indians to Malaysia as indentured labourers a century ago.

The activists also demand measures to improve the living standards of Hindus.

But the government has banned the event, saying it could inflame racial tensions. It warned that anyone trying to take part would be arrested.

The three detained on Friday include the chairman of the Hindu Rights Action Force (Hindraf), Waytha Moorthy Ponnusamy, and two of his associates.

'Discrimination'

Hindraf hopes to hold a demonstration outside the British High Commission in Kuala Lumpur on Sunday.


The three men were later charged with making seditious comments - and could face up to three years in jail if convicted.

The government has set up a security cordon around Kuala Lumpur, and banned the rally citing possible violence.

Malaysia bans public meetings of more than five people without a police permit.

Ethnic Indians - mainly Hindus - form one of Malaysia's largest minority groups.

Activists say that many Hindus live in poverty, partly because of policies granting jobs and economic advantages to the ethnic Malay Muslim majority.

The government has rejected claims of unfair discrimination.

ஆனால், இஸ்லாமிய் ஷாரியாவின் படி ஒரு முஸ்லீமின் பணத்தை முஸ்லீமல்லாத ஒருவர் அடையக்கூடாதாம். அதனால் இந்த பெண்மணிக்கு பணம் கொடுக்க இன்சூரன்ஸ் மறுக்கிறது.

இதனை எதிர்த்து வழக்கு போட்டிருக்கிறார்கள்.

இந்த பெண்மணிக்கு நியாயம் கிடைத்து தன் இறுதி காலத்தில் தன் மகனது இன்சூரன்ஸ் பணத்தை பெற இறையருளை வேண்டுவோம்.

Rukumony Muthiah was named as beneficiary in her son’s trust deed


GEORGE TOWN: A soldier, who died after converting to Islam, has left his mother fighting a legal battle for the past seven years to claim his insurance payout.

This is because Koperasi Angkatan Tentera, which took out the insurance policy, had deposited the RM56,300 payout with Amanah Raya Berhad, a government-owned trustee company.

The co-operative said Rukumony Muthiah, a widow, could not inherit the money because under syariah a non-Muslim cannot inherit the property of a Muslim.

Rukumony, who works as a cleaner, was named as the beneficiary under a trust deed made by her son before his conversion.

Her son, E. Ragu, was a bachelor and had converted to Islam on Dec 31, 1999.

His Muslim name was Mohamed Redzuan Abdullah Ellaippan.

Mohamed Redzuan was a ranger based at the Wardie- burn camp in Setapak. He died on Aug 2, 2000.

Rukumony has engaged lawyer Darshan Singh Khaira and Wong Hon Wai to fight her case.

The Majlis Agama Islam Wilayah Persekutuan, represented by Abdul Muiz Samsuri, had entered into the litigation after applying to intervene in the matter.

Amanah Raya Berhad was represented by Rosmaidar Mustafa.

In his written submissions, Darshan argued that even though Rukumony's son had converted, he could still make a Trust Deed and Assignment in favour of a non-Muslim.

He said this meant that the insurance payout did not form part of Mohamed Redzuan's estate and therefore the religious council had no interest in the money.

He also argued that the syariah principle that a non- Muslim cannot inherit a Muslim's property was discriminatory and had been modified by the equality clause 8 under the Federal Constitution.

The case was yesterday adjourned to Nov 27 by High Court judge John Lois O'Hara.

மலேசியாவில் முஸ்லீம்கள் பெரும்பான்மையினராக உள்ளனர். கடந்த வியாழக்கிழமை ரம்ஜான் நோன்பு தொடங்கியது.

நோன்புக் காலத்தில், பகல் நேரத்தில் சாப்பிடாமல், மது அருந்தாமல், புகை பிடிக்காமல், செக்ஸ் வைத்துக் கொள்ளாமல், மனதையும், உடலையும் கட்டுப்பாட்டோடு வைத்துக் கொள்ள வேண்டும் என்பது விதியாகும்.

இந் நிலையில் இந்த விதிமுறைகளை அனைவரும் முறையாகக் கடைப்பிடிக்கிறார்களா என்பதைக் கண்காணிக்க கெலன்டான் மாநில அரசு புதிய படை ஒன்றை உருவாக்கியுள்ளது.

இந்த மாநில அரசை நிர்வகித்து வரும் இஸ்லாம் சே மலேசியா என்ற கட்சி 10 அதிகாரிகள் கொண்ட படையை நியமித்துள்ளது. சாதாரண உடையில் வலம் வரும் இந்த அதிகாரிகள், நோன்புக் காலத்தின்போது மது அருந்துவோர், புகை பிடிப்போர் மற்றும் சாப்பிடுவோரைப் பிடிப்பார்கள்.

உணவகங்கள் உள்ளிட்ட இடங்களில் இவர்கள் தீவிரமாக கண்காணிப்பார்கள். இப்படி ஒரு தனிப்படை அமைக்கப்பட்டிருப்பது இதுவே முதல் முறை என்பது குறிப்பிடத்தக்கது.

விதிகளை மீறியதற்காக தனிப்படையிடம் பிடிபடுவோருக்கு குறைந்தபட்ச அபராதமாக 20 ரிங்கிட் (அதாவது 6 டாலர்கள்) விதிக்கப்படும். உணவை விற்பவருக்கு 500 மலேசிய ரிங்கிட் (144 டாலர்கள்) அபராதம் விதிக்கப்படும்.

இந்தக் கட்சி மலேசியாவை முழுமையான இஸ்லாமிய நாடாக மாற்ற கோரி வரும் கட்சி என்பது குறிப்பிடத்தக்கது.

மலேசிய மக்கள் தொகையில், 60 சதவீதம் பேர் முஸ்லீம்கள். 20 சதவீதம் பேர் புத்த மதத்தினர், கிறிஸ்தவர்கள் எண்ணிக்கை 10 சதவீதமாகும். இந்துக்கள் 6 சதவீதம் பேர் உள்ளனர்.

இந்த பூமிபுத்ரா முறை மலேசிய அபார்தெய்ட் என்றால் மிகையாகாது.



Samy Vellu hits back at Hindu Rights Action Force

MIC president Datuk Seri S. Samy Vellu today launched a stinging attack against a non-governmental organisation, the Hindu Rights Action Force (HINDRAF), which claimed that the Barisan Nasional (BN) government had done little to address the woes of the Malaysian Indian community over the last 50 years.

“I must state here that if there is anything that affects the Indian community, the MIC will be there to fight it out even when we are partners of the Barisan Nasional. To me, I have never remained idle and I don’t waste time,” Samy Vellu, who is also Works Minister, told Bernama today.

The MIC supremo was asked to comment on a 18-point memorandum by HINDRAF, which was handed to the Prime Minister’s office last Sunday by the organisation’s chairman P. Waytha Moorthy, secretary V.K Regu and its legal adviser P. Uthayakumar.

Apart from stating that the Indian community was marginalised by the BN government, in the memorandum, HINDRAF also wanted an end to special privileges given to Malays. The memorandum also took a dig at Umno asking the largest political party in the country to “stop playing politics" through the “mandore” (supervisor) system by dishing out aid to the Indian community on a piecemeal basis.

KUALA LUMPUR: Islamic authorities in Malaysia have freed a Muslim woman after detaining her for four months for marrying a Hindu, the couple's lawyer said on Saturday.

The Selangor state Islamic authorities have, however, ordered the 25-year-old ethnic Indian woman to live separately from her husband, arguing that her year-old marriage was illegal under Islam. In Malaysia, Muslims cannot marry non-Muslims.

Her case is the latest strain in the social fabric of the multiracial nation, where many non-Muslims believe the authorities and the courts are allowing their rights to be trampled by the Muslim majority. "Her husband's family rang us up to say she has been released about three weeks ago," said Karpal Singh who had argued in the past that Najeera Farvinli Mohamed Jalali's detention was illegal because no detention order was served on her.

Her husband, a 25-year-old truck driver Magendran Sababathy, had hired Karpal to fight for his wife's freedom. Islamic religious police had raided the couple's house in April and arrested her, arguing she was "illegally cohabiting" with a Hindu and for for failing to produce any relevant marriage documents. A prominent rights lawyer questioned the decision to separate Najeera from her husband. "I don't think there's a legal basis for them to do it," Malik Imtiaz Sarwar said.

"I don't know whether they can do that. I don't see where the powers to do so is" "If she is saying she is not a Muslim, the Constitution guarantees her right to say that and nobody can order her to do anything other than that." Officials could not be immediately reached for comment on the woman's release and the order that she stay with her parents.

Just over half of Malaysia's 26 million people are Malays, who are Muslims by definition. Ethnic Chinese and Indians form the sizeable minorities and they practice either Buddhism, Christianity or Hinduism. Last month, a 29-year-old woman said she was mentally tortured by islamic religious police during her six-month detention for renouncing Islam in favour of the Hindu religion.

In May, the country's best-known Christian convert, Lina Joy, lost a battle in Malaysia's highest court to have the word "Islam" removed from her identity card. In delivering judgment in that case, the chief judge said the issue of apostasy was related to Islamic law, and civil courts could not intervene.
